  1  4 CONCERNING THE RELEASE OF INFORMATION BY THE DEPARTMENT
  1  5    OF TRANSPORTATION TO GOVERNMENTAL EMPLOYEES.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 321.11, unnumbered paragraph 3, Code
  1 10 Supplement 1997, is amended to read as follows:
  1 11    Notwithstanding other provisions of this section to the
  1 12 contrary, the department shall not release personal
  1 13 information to a person, other than to an officer or employee
  1 14 of a law enforcement agency, an employee of a federal or state
  1 15 agency or political subdivision in the performance of the
  1 16 employee's official duties, a contract employee of the
  1 17 department of inspections and appeals in the conduct of an
  1 18 investigation, or a licensed private investigation agency or a
  1 19 licensed security service or a licensed employee of either, if
  1 20 the information is requested by the presentation of a
  1 21 registration plate number.  However, In addition, an officer
  1 22 or employee of a law enforcement agency may release the name,
  1 23 address, and telephone number of a motor vehicle registrant to
  1 24 a person requesting the information by the presentation of a
  1 25 registration plate number if the officer or employee of the
  1 26 law enforcement agency believes that the release of the
  1 27 information is necessary to prevent an unlawful act in the
  1 28 performance of the officer's or employee's duties.  A person
  1 29 seeking the information shall state in writing the nature of
  1 30 the unlawful act that the person is attempting to prevent.
