PAG LIN 1 1 Section 1. NEW SECTION. 86.10A WORKERS' COMPENSATION 1 2 RECORDS CONFIDENTIALITY. 1 3 A record maintained by the department of workforce 1 4 development that reveals the identity of an employee who 1 5 claims workers' compensation benefits under chapter 85, 85A, 1 6 or 85B, the nature of the employee's claimed injury, the 1 7 employee's past or present medical condition, the extent of 1 8 the employee's disability, and the amount, type, and duration 1 9 of benefits paid to the employee is deemed confidential for 1 10 purposes of section 22.7 and not open to public inspection or 1 11 copying. The department shall deny a request made to inspect 1 12 or copy a record that is confidential under this section, 1 13 unless one of the following applies: 1 14 1. The requester is the employee who is the subject of the 1 15 record or an attorney or authorized agent of that employee. 1 16 An attorney or authorized agent of an employee who is the 1 17 subject of a record shall provide a written authorization for 1 18 inspection and copying from the employee if requested by the 1 19 department. 1 20 2. The record that is requested contains confidential 1 21 information concerning a workers' compensation claim and the 1 22 requester is an insurance carrier or employer that is a party 1 23 to the claim or an attorney or authorized agent of that 1 24 insurance carrier or employer. 1 25 3. The record that is requested contains financial 1 26 information provided by a self-insured employer or by an 1 27 applicant for exemption and the requester is the self-insured 1 28 employer or applicant for exemption or an attorney or 1 29 authorized agent of the self-insured employer or applicant for 1 30 exemption. 1 31 EXPLANATION 1 32 This bill provides that records maintained by the 1 33 department of workforce development concerning workers' 1 34 compensation cases shall be deemed confidential and not 1 35 releasable except as provided in the bill. The bill provides 2 1 that the information can be released to the employee, or the 2 2 employee's attorney or agent, who is the subject of the 2 3 record, to an insurance carrier or employer who is a party to 2 4 the claim giving rise to the record, or to a self-insured 2 5 employer or applicant for exemption if the record contains 2 6 financial information provided by that employer or applicant. 2 7 LSB 3988XS 77 2 8 ec/jl/8
