1 1 Section 1. Section 236.12, subsection 1, paragraph a, Code
1 2 1997, is amended to read as follows:
1 3 a. If requested, remaining on the scene as long as there
1 4 is a danger to an abused person's physical safety without the
1 5 presence of a peace officer, including but not limited to
1 6 staying in the dwelling unit, or if unable to remain on the
1 7 scene, assisting the person in leaving the residence. If
1 8 necessary, the officer shall accompany the abused person into
1 9 the dwelling unit so that the abused person may remove
1 10 personal clothing and personal effects, including any medicine
1 11 or medical devices, of the abused person and of any child in
1 12 the abused person's care, as required for the immediate needs
1 13 of the abused person or child. The abused person shall be
1 14 allowed to remove such items notwithstanding the claim that
1 15 the abused person did not pay for such items.
