  1  1    Section 1.  Section 566.15, unnumbered paragraph 1, Code
  1  2 l997, is amended to read as follows:
  1  3    The board of supervisors, mayor and council, or other
  1  4 elected governmental body, as the case may be, has the
  1  5 authority to receive and invest all moneys and property,
  1  6 donated or bequeathed, and that portion of cemetery lot sales
  1  7 and permanent charges made against cemetery lots which have
  1  8 been set aside in a perpetual care fund, in investments for
  1  9 which they have exercised the judgment and care, under the
  1 10 circumstances then prevailing, which persons of prudence,
  1 11 discretion, and intelligence exercise in the management of
  1 12 their affairs.  The income from the investment shall be used
  1 13 in caring for the property of the donor in any cemetery, or as
  1 14 shall be provided in the terms of the gift or donations or
  1 15 agreement for sale and purchase of a cemetery lot.  For a
  1 16 city-owned cemetery, the perpetual care fund shall have a
  1 17 minimum balance of fifty thousand dollars.  When the minimum
  1 18 balance is achieved, a city may use the proceeds from the
  1 19 sales of cemetery lots for the operation and maintenance of
  1 20 the cemetery.  
  1 21                           EXPLANATION 
  1 22    This bill provides that a city shall maintain a $50,000
  1 23 minimum balance in a perpetual care fund for each city-owned
  1 24 cemetery.  When the minimum balance is achieved, a city may
  1 25 use the proceeds from the sales of cemetery lots for the
  1 26 operation and maintenance of the cemetery.
