PAG LIN 1 1 Section 1. Section 139.9, subsection 2, Code 1997, is 1 2 amended to read as follows: 1 3 2. a. A person shall not be enrolled in any licensed 1 4 child care center, elementary or secondary school in Iowa 1 5 without evidence of adequate immunization against diphtheria, 1 6 pertussis, tetanus, poliomyelitis, rubeola, and rubella. 1 7 b. Evidence of adequate immunization against haemophilus 1 8 influenza b shall be required prior to enrollment in any 1 9 licensed child care center. 1 10 c. Evidence of hepatitis type B immunization shall be 1 11 required prior to enrollment in school in kindergarten or in 1 12 any grade level. 1 13 d. Immunizations shall be provided according to 1 14 recommendations provided by the Iowa department of public 1 15 health subject to the provisions of subsections 3 and 4. 1 16 Sec. 2. HEPATITIS TYPE B PLAN. The Iowa department of 1 17 public health shall develop a plan for protecting Iowans 1 18 against hepatitis type B and requiring that minor children be 1 19 adequately immunized against hepatitis type B. The plan shall 1 20 incorporate the health and religious exemptions in section 1 21 139.9, subsections 3 and 4. The plan shall be submitted to 1 22 the governor and general assembly by October 1, 1998. 1 23 Sec. 3. IMPLEMENTATION OF ACT. Section 25B.2, subsection 1 24 3, shall not apply to this Act. 1 25 Sec. 4. RULES APPLICABILITY. Section 1 of this Act, 1 26 requiring evidence of hepatitis type B immunization, shall 1 27 first be applicable to enrollments for the 1999-2000 school 1 28 year. The Iowa department of public health shall adopt rules 1 29 on or before October 1, 1998, to implement the provisions of 1 30 section 1 of this Act. 1 31 Sec. 5. EFFECTIVE DATE. This Act, being deemed of 1 32 immediate importance, takes effect upon enactment. 1 33 EXPLANATION 1 34 This bill relates to hepatitis type B immunizations of 1 35 children and requires the Iowa department of public health to 2 1 develop a plan for protecting persons against hepatitis type B 2 2 and requiring hepatitis type B immunizations of children. The 2 3 plan is to be submitted to the governor and general assembly 2 4 by October 1, 1998. 2 5 The bill requires evidence of hepatitis type B immunization 2 6 for children enrolling in school in kindergarten or in any 2 7 grade level. The requirement is first applicable to children 2 8 enrolling for the 1999-2000 school year. Existing provisions 2 9 for health and religious exemptions are applicable. 2 10 This bill may include a state mandate as defined in Code 2 11 section 25B.3. This bill makes inapplicable Code section 2 12 25B.2, subsection 3, which would relieve a political 2 13 subdivision from complying with a state mandate if funding for 2 14 the cost of the state mandate is not provided or specified. 2 15 Therefore, political subdivisions are required to comply with 2 16 any state mandate included in this bill. 2 17 The bill takes effect upon enactment. 2 18 LSB 3405XS 77 2 19 jp/jl/8
