  1  1    Section 1.  Section 462A.15, Code 1997, is amended to read
  1  2 as follows:
  1  3    462A.15  WATER SKIS AND SURFBOARDS.
  1  4    1.  No A person shall not operate a vessel on any waters of
  1  5 this state under the jurisdiction of the commission for towing
  1  6 a person or persons on water skis, surfboard, or similar
  1  7 device unless there is in such vessel a responsible person is
  1  8 in such vessel, in addition to the operator, in a position to
  1  9 observe the progress of the person or persons being towed.
  1 10 Each vessel towing a person on water skis, surfboard, or
  1 11 similar device shall also have a safety flag attached to the
  1 12 rear of the vessel which extends not less than five feet above
  1 13 the water.  The safety flag shall be triangular in shape with
  1 14 an area of not less than thirty square inches, and be Day-Glo
  1 15 in color.  A person convicted of a violation of this
  1 16 subsection is guilty of a simple misdemeanor punishable as a
  1 17 scheduled violation under section 805.8, subsection 3,
  1 18 paragraph "c".
  1 19    2.  The provisions of subsections 1 and 2 of this This
  1 20 section do does not apply to a performer or person engaged in
  1 21 a professional exhibition or a person or persons engaged in a
  1 22 professional exhibition or to a person or persons engaged in
  1 23 an activity authorized under section 462A.16.  
  1 24                           EXPLANATION
  1 25    This bill requires boats to display a safety flag while
  1 26 pulling a water skier.  The safety flag shall be displayed at
  1 27 least five feet above the water, and be Day-Glo in color.  In
  1 28 addition, the flag must be triangular in shape and be at least
  1 29 30 square inches in size.  The penalty for violating this bill
  1 30 is a scheduled fine of $25.
