1 1 Section 1. Section 728.5, subsection 6, Code Supplement
1 2 1997, is amended to read as follows:
1 3 6. If such person allows or permits a minor to engage in
1 4 or otherwise perform in, or to remain in or upon the premises
1 5 of the place of business during the performance of, a live act
1 6 intended to arouse or satisfy the sexual desires or appeal to
1 7 the prurient interests of patrons. However, if such person
1 8 allows or permits a minor to participate in any act included
1 9 in subsections 1 through 4, the person shall be guilty of an
1 10 aggravated misdemeanor.
1 11 EXPLANATION
1 12 This bill provides that a person who owns, manages, or
1 13 controls a place of business which permits a minor to remain
1 14 in the place of business during the performance of a live act
1 15 intended to arouse or satisfy the sexual desires or appeal to
1 16 the prurient interests of patrons of the business shall be
1 17 guilty of a serious misdemeanor.
