  1  1    Section 1.  Section 252H.12, subsection 2, Code 1997, is
  1  2 amended to read as follows:
  1  3    2.  The support order provides for the ongoing support of
  1  4 at least one child under the age of eighteen or a child
  1  5 between the ages of eighteen and through nineteen years of age
  1  6 who has not yet graduated from high school but who is
  1  7 reasonably expected to graduate from engaged full-time in
  1  8 completing high school before attaining the age of nineteen
  1  9 graduation or equivalency requirements.
  1 10    Sec. 2.  Section 598.1, subsection 9, Code Supplement 1997,
  1 11 is amended to read as follows:
  1 12    9.  "Support" or "support payments" means an amount which
  1 13 the court may require either of the parties to pay under a
  1 14 temporary order or a final judgment or decree, and may include
  1 15 alimony, child support, maintenance, and any other term used
  1 16 to describe these obligations.  For orders entered on or after
  1 17 July 1, 1990, unless the court specifically orders otherwise,
  1 18 medical support is not included in the monetary amount of
  1 19 child support.  The obligations shall include support for a
  1 20 child who is between the ages of eighteen and through nineteen
  1 21 years who of age if the child is engaged full-time in
  1 22 completing high school graduation or equivalency requirements
  1 23 in a manner which is reasonably expected to result in
  1 24 completion of the requirements prior to the person reaching
  1 25 nineteen years of age; and may include support for a child of
  1 26 any age who is dependent on the parties to the dissolution
  1 27 proceedings because of physical or mental disability.  
  1 28                           EXPLANATION
  1 29    This bill provides that child support shall be provided to
  1 30 a child through 19 years of age if the child is engaged full-
  1 31 time in completing high school graduation or equivalency
  1 32 requirements.  The bill eliminates current language which
  1 33 requires that the graduation or equivalency requirements be
  1 34 reasonably expected to be completed prior to the child
  1 35 reaching 19 years of age, thereby allowing the child to
  2  1 complete the requirements through the child's 19th year.  The
  2  2 bill also makes a conforming change in the chapter of the Code
  2  3 relating to review and adjustment of child support orders.
