  1  1    Section 1.  Section 282.18, subsection 13, Code Supplement
  1  2 1997, is amended to read as follows:
  1  3    13.  a.  A pupil who participates in open enrollment for
  1  4 purposes of attending a grade in grades ten through twelve in
  1  5 a school district other than the district of residence is
  1  6 ineligible to participate in interscholastic athletic contests
  1  7 and athletic competitions during the pupil's first ninety
  1  8 school days of enrollment in the district except that the
  1  9 pupil may participate immediately in an interscholastic sport
  1 10 if under any of the following circumstances:
  1 11    (1)  If the district of residence and the other school
  1 12 district jointly participate in the sport, if.
  1 13    (2)  If the sport in which the pupil wishes to participate
  1 14 is not offered in the district of residence, if.
  1 15    (3)  If the pupil chooses to use open enrollment to attend
  1 16 school in another school district because the district in
  1 17 which the student previously attended school was dissolved and
  1 18 merged with one or more contiguous school districts under
  1 19 section 256.11, subsection 12, if.
  1 20    (4)  If the pupil participates in open enrollment because
  1 21 the pupil's district of residence has entered into a whole
  1 22 grade sharing agreement with another district for the pupil's
  1 23 grade, or if.
  1 24    (5)  If the pupil was enrolled in an accredited nonpublic
  1 25 school that did not offer the sport in which the pupil wishes
  1 26 to participate and the pupil enrolled in the district of
  1 27 residence which does offer the sport only in order to
  1 28 participate in open enrollment.
  1 29    (6)  If the parent or guardian of the pupil participating
  1 30 in open enrollment is an active member of the armed forces and
  1 31 resides in permanent housing on government property provided
  1 32 by a branch of the armed services.
  1 33    b.  A pupil who has paid tuition and attended school, or
  1 34 has attended school pursuant to a mutual agreement between the
  1 35 two districts, in a district other than the pupil's district
  2  1 of residence for at least one school year prior to March 10,
  2  2 1989, is also eligible to participate immediately in
  2  3 interscholastic athletic contests and athletic competitions
  2  4 under this section, but only as a member of a team from the
  2  5 district that pupil had attended.
  2  6    c.  For purposes of this subsection, "school days of
  2  7 enrollment" do not include enrollment in summer school.  
  2  8                           EXPLANATION 
  2  9    This bill permits students who are enrolled at an
  2 10 accredited nonpublic school that does not offer a sport the
  2 11 student wishes to participate in, and who must enroll in their
  2 12 district of residence as a means of participating in open
  2 13 enrollment to another district, to participate immediately in
  2 14 the sport in the receiving district even if the district of
  2 15 residence offers the sport in which the pupil wishes to
  2 16 participate.
  2 17    Currently under the Code, a student who wishes to
  2 18 participate in open enrollment must be enrolled in their
  2 19 district of residence.  Therefore, a student attending an
  2 20 accredited nonpublic school cannot participate in open
  2 21 enrollment without procedurally enrolling in their district of
  2 22 residence.  If the district of residence offers a sport the
  2 23 student wishes to participate in, the student, who only
  2 24 enrolled in order to attend school in the receiving district,
  2 25 is currently prohibited from participating in the sport during
  2 26 the pupil's first 90 school days of enrollment in the
  2 27 receiving district.
