1 1 Section 1. Section 321.446, Code 1997, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 3A. Notwithstanding subsections 2 and 3
1 4 and section 321.445, subsection 2, paragraph "d", a child at
1 5 least three years of age but under six years of age who is
1 6 enrolled in preschool, who requires and receives special
1 7 education services as defined in section 256B.2, and is being
1 8 transported for school-related purposes in a motor vehicle
1 9 subject to registration which has a gross weight of ten
1 10 thousand pounds or less as specified by the manufacturer,
1 11 except a motorcycle, shall be secured during transit by a
1 12 child restraint system that meets federal motor vehicle safety
1 13 standards and the system shall be used in accordance with the
1 14 manufacturer's instructions.
1 15 EXPLANATION
1 16 This bill requires that a child who is at least three years
1 17 of age but under six years of age, who is enrolled in
1 18 preschool and requires and receives special education
1 19 services, be secured during transit for school-related
1 20 purposes in a motor vehicle by a federally approved child
1 21 restraint system.
