1 1 Section 1. Section 354.22, unnumbered paragraph 1, Code
1 2 1997, is amended to read as follows:
1 3 The proprietors of lots within an official plat who wish to
1 4 vacate any portion of the official plat shall file a petition
1 5 for vacation with the governing body which would have
1 6 jurisdiction to approve the plat at the time the petition is
1 7 filed. After the petition has been filed, the governing body
1 8 shall fix the time and place for public hearing on the
1 9 petition. Written notice of the proposed vacation shall be
1 10 served in the manner of original notices as provided in Iowa
1 11 rules of civil procedure or by certified mail and be served
1 12 upon proprietors and mortgagees within the official plat that
1 13 are within three hundred feet of the area to be vacated. If a
1 14 portion of the official plat adjoins a river or state-owned
1 15 lake, the Iowa department of natural resources shall be served
1 16 written notice of the proposed vacation. Notice of the
1 17 proposed vacation shall be published twice, with fourteen days
1 18 between publications, stating the date, time, and place of the
1 19 hearing.
1 20 EXPLANATION
1 21 This bill provides that written notice of a proposed
1 22 vacation of an official plat may be served by certified mail
1 23 in lieu of being served in the manner of original notices as
1 24 provided in the Iowa rules of civil procedure.
