1 1 Section 1. Section 455B.104, Code 1997, is amended to read
1 2 as follows:
1 3 455B.104 DEPARTMENTAL DUTIES – PERMITS – ASSISTANCE.
1 4 1. The department shall either approve or deny a permit to
1 5 a person applying for a permit under this chapter, within six
1 6 months from the date that the department receives a completed
1 7 application for the permit. An application which is not
1 8 approved or denied within the six-month period shall be
1 9 approved by default. The department shall issue a permit to
1 10 the applicant within ten days following the date of default
1 11 approval. However, this section shall not apply to
1 12 applications for permits which are issued under division II,
1 13 or division IV, parts 2 through 7.
1 14 2. The department shall assist persons applying for
1 15 assistance to establish and operate renewable fuel production
1 16 facilities pursuant to the value-added agricultural products
1 17 and processes financial assistance program established in
1 18 section 15E.111.
1 19 3. The department shall deny a permit application for any
1 20 type of facility when the applicant fails to demonstrate an
1 21 ownership interest in the land which is the location for the
1 22 facility.
1 23 EXPLANATION
1 24 This bill requires the department of natural resources to
1 25 deny a permit application for any facility when the applicant
1 26 fails to demonstrate an ownership interest in the land on
1 27 which the facility is to be located.
