  1  1    Section 1.  Section 359.33, Code 1997, is amended to read
  1  2 as follows:
  1  3    359.33  TAX FOR NONOWNED CEMETERY.
  1  4    They The township trustees may levy a tax not to exceed six
  1  5 and three-fourths cents per thousand dollars of assessed value
  1  6 of taxable property to improve and maintain any cemetery not
  1  7 owned by the township, provided the same if the cemetery is
  1  8 devoted to general public use.  
  1  9                           EXPLANATION
  1 10    This bill strikes the property tax limitation of six and
  1 11 three-fourths cents per thousand dollars of assessed value of
  1 12 taxable property which township trustees may levy annually to
  1 13 pay for the improvement and maintenance of cemeteries which
  1 14 are not owned by the township.  The cemeteries must be devoted
  1 15 to general public use.
