  1  4 PROHIBITING THE POSSESSION OR DISTRIBUTION OF GAMMA-HYDROXY-
  1  5    BUTYRIC ACID UNDER CERTAIN CIRCUMSTANCES, AND PROVIDING A
  1  6    PENALTY.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  9 
  1 10    Section 1.  NEW SECTION.  126.27  GAMMA-HYDROXYBUTYRATE.
  1 11    1.  UNLAWFUL POSSESSION.  Any person who possesses gamma-
  1 12 hydroxybutyrate (also known as gamma-hydroxybutyric acid, or
  1 13 GHB), or any substance containing gamma-hydroxybutyrate
  1 14 commits an aggravated misdemeanor.  This subsection shall not
  1 15 apply to any person who obtains or possesses gamma-
  1 16 hydroxybutyrate or any material containing gamma-
  1 17 hydroxybutyrate pursuant to a lawful order of a physician or
  1 18 other authorized prescriber for the legitimate treatment of
  1 19 disease.
  1 20    2.  UNLAWFUL DISTRIBUTION.  Any person who distributes
  1 21 gamma-hydroxybutyrate, or possesses gamma-hydroxybutyrate with
  1 22 the intent to distribute to any other person, commits an
  1 23 aggravated misdemeanor if the person intends to promote or
  1 24 allow the unlawful use of the substance or if the person knows
  1 25 that the other person will use the substance for unlawful
  1 26 purposes.
