  1  1    Section 1.  Section 256.11, Code 1997, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  9.  Unless a waiver has been obtained
  1  4 under section 256.11A, each school or school district shall
  1  5 have all of the following:
  1  6    a.  A media center in each attendance center accessible to
  1  7 students throughout the school day.
  1  8    b.  A qualified school media specialist who shall meet the
  1  9 licensing standards prescribed by the board of educational
  1 10 examiners and be responsible for media center supervision.
  1 11    c.  An articulated sequential elementary-secondary guidance
  1 12 program for grades kindergarten through twelve.  The guidance
  1 13 counselor shall meet the licensing standards prescribed by the
  1 14 board of educational examiners.
  1 15    In determining the requirements of this subsection for
  1 16 nonpublic schools, the department shall evaluate the schools
  1 17 on a school system basis rather than on an individual school
  1 18 basis.
  1 19    Sec. 2.  Section 256.11A, subsections 1 and 2, Code 1997,
  1 20 are amended to read as follows:
  1 21    1.  Schools and school districts unable to meet the
  1 22 standard adopted by the state board requiring each school or
  1 23 school district operating a kindergarten through grade twelve
  1 24 program to provide an articulated sequential elementary-
  1 25 secondary guidance program may, not later than August 1, 1995
  1 26 1997, for the school year beginning July 1, 1995 1997, file a
  1 27 written request to the department of education that the
  1 28 department waive the requirement, for established in section
  1 29 256.11, subsection 9, paragraph "c", that a school or school
  1 30 district operating a kindergarten through grade twelve
  1 31 program, provide an articulated sequential elementary-
  1 32 secondary guidance program.  The procedures specified in
  1 33 subsection 3 apply to the request.  Not later than August 1,
  1 34 1996 1998, for the school year beginning July 1, 1996 1998,
  1 35 the board of directors of a school district or the authorities
  2  1 in charge of a nonpublic school may request a one-year
  2  2 extension of the waiver.
  2  3    2.  Not later than August 1, 1995 1997, for the school year
  2  4 beginning July 1, 1995 1997, the board of directors of a
  2  5 school district, or authorities in charge of a nonpublic
  2  6 school, may file a written request with the department of
  2  7 education that the department waive the rule adopted by the
  2  8 state board to establish and operate the requirements
  2  9 established under section 256.11, subsection 9, paragraphs "a"
  2 10 and "b", for a media services specialist and a media services
  2 11 program to support the total curriculum for that district or
  2 12 school center.  The procedures specified in subsection 3 apply
  2 13 to the request.  Not later than August 1, 1996 1998, for the
  2 14 school year beginning July 1, 1996 1998, the board of
  2 15 directors of a school district or the authorities in charge of
  2 16 a nonpublic school may request an additional one-year
  2 17 extension of the waiver.  
  2 18                           EXPLANATION
  2 19    This bill reestablishes a statutory requirement that each
  2 20 school or school district have, unless a waiver has been
  2 21 obtained, a media center in each attendance center accessible
  2 22 to students throughout the school day, a qualified school
  2 23 media specialist responsible for media center supervision, and
  2 24 an articulated sequential elementary-secondary guidance
  2 25 program for grades kindergarten through 12.  The bill also
  2 26 extends the time in which schools may apply for waivers to
  2 27 August 1, 1998.
