1 1 Section 1. Section 252.16, Code 1997, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 9. A child who is placed in a juvenile
1 4 shelter care home which is publicly owned, operated as a
1 5 county or multicounty shelter care home, organized under a
1 6 chapter 28E agreement, or operated by a private juvenile
1 7 shelter care home assumes the settlement of the child's
1 8 custodial parent or legal guardian or custodian. Settlement
1 9 of the child changes with the settlement of the child's
1 10 custodial parent or legal guardian or custodian. Recovery of
1 11 the costs of a child's placement in a juvenile shelter care
1 12 home is subject to section 232.141, subsection 8.
1 13 EXPLANATION
1 14 This bill provides that a child who is placed in a juvenile
1 15 shelter care home assumes the legal settlement of the child's
1 16 custodial parent or legal guardian or custodian and that legal
1 17 settlement of the child changes with the settlement of the
1 18 child's custodial parent or legal guardian or custodian. The
1 19 bill also provides that recovery of the costs of care in a
1 20 juvenile shelter care home from the county of legal settlement
1 21 is limited to the difference between the amount the department
1 22 of human services is authorized to pay and the statewide
1 23 average of the actual and allowable rates in effect in May of
1 24 the preceding fiscal year for reimbursement of juvenile
1 25 shelter care homes and in no case is reimbursement to exceed
1 26 the home's actual and allowable costs.
