1 1 Section 1. NEW SECTION. 135C.31A MEDICAL ASSISTANCE –
1 2 RETROACTIVE APPLICABILITY TO PAYMENT OF COSTS.
1 3 A health care facility shall reimburse a resident in the
1 4 amount which is the difference between the facility's charge
1 5 for the care and the reimbursement rate paid under the medical
1 6 assistance program pursuant to chapter 249A for the care, for
1 7 any costs paid by the resident, retroactively, to the first
1 8 date on which the resident was eligible for medical
1 9 assistance, but prior to the date the resident was notified of
1 10 eligibility.
1 11 EXPLANATION
1 12 This bill requires that a resident of a health care
1 13 facility be reimbursed by the facility, in an amount that is
1 14 the difference between the facility's charge for the care and
1 15 the reimbursement rate paid under the medical assistance
1 16 program for the care, retroactively, for any costs paid by the
1 17 resident during the time between the first date on which the
1 18 resident was eligible for medical assistance but prior to the
1 19 date of notification of the resident of eligibility. A health
1 20 care facility which violates this section is subject to
1 21 penalties pursuant to section 135C.36 for a class III
1 22 violation.
