PAG LIN 1 1 Section 1. Section 135C.19, subsection 1, Code 1997, is 1 2 amended to read as follows: 1 3 1. Following an inspection of a health care facility by 1 4 the department pursuant to this chapter, the department's 1 5 final findings with respect to compliance by the facility with 1 6 requirements for licensing shall be made available to the 1 7 public in a readily available form and place. The final 1 8 findings shall also be forwarded to the area agency on aging 1 9 designated for the area in which the health care facility is 1 10 located. Other information relating to a health care facility 1 11 obtained by the department which does not constitute the 1 12 department's findings from an inspection of the facility shall 1 13 not be made available to the public except in proceedings 1 14 involving the citation of a facility for a violation under 1 15 section 135C.40, or the denial, suspension, or revocation of a 1 16 license under this chapter. The name of a person who files a 1 17 complaint with the department shall be confidential. 1 18 Sec. 2. Section 135C.19, subsection 2, unnumbered 1 19 paragraph 2, Code 1997, is amended to read as follows: 1 20 A copy of each citation required to be posted by this 1 21 subsection shall be sent by the department to the department 1 22 of human services,andto the designated protection and 1 23 advocacy agency if the facility has one or more residents with 1 24 developmental disabilities or mental illness, and to the area 1 25 agency on aging designated for the area in which the health 1 26 care facility is located. 1 27 EXPLANATION 1 28 This bill provides that findings of the department of 1 29 inspections and appeals following an inspection of a health 1 30 care facility which are made public and a copy of a class I or 1 31 class II violation by a health care facility are to be 1 32 forwarded to the area agency on aging which is designated for 1 33 the area in which the facility is located. 1 34 LSB 2499XS 77 1 35 pf/sc/14
