  1  1    Section 1.  Section 249A.12, subsection 4, Code 1997, is
  1  2 amended to read as follows:
  1  3    4.  a.  Effective July 1, 1995 1997, the state shall be
  1  4 responsible for all of the nonfederal share of the costs of
  1  5 intermediate care facility for persons with mental retardation
  1  6 services provided under medical assistance to minors and to
  1  7 children requiring special education, as defined in section
  1  8 256B.2.  Notwithstanding subsection 2 and contrary provisions
  1  9 of section 222.73, effective July 1, 1995 1997, a county is
  1 10 not required to reimburse the department and shall not be
  1 11 billed for the nonfederal share of the costs of such services
  1 12 provided to minors and to children requiring special
  1 13 education, as defined in section 256B.2.
  1 14    b.  Effective July 1, 1995 1997, the state shall be
  1 15 responsible for all of the nonfederal share of medical
  1 16 assistance home and community-based waivers for persons with
  1 17 mental retardation services provided under medical assistance
  1 18 to minors and to children requiring special education, as
  1 19 defined in section 256B.2, and a county is not required to
  1 20 reimburse the department and shall not be billed for the
  1 21 nonfederal share of the costs of the services.
  1 22    Sec. 2.  Section 426B.1, subsection 3, Code 1997, is
  1 23 amended to read as follows:
  1 24    3.  There is annually appropriated from the property tax
  1 25 relief fund to the department of human services to supplement
  1 26 the medical assistance appropriation for the fiscal year
  1 27 beginning July 1, 1997, and for succeeding fiscal years, six
  1 28 million six hundred thousand dollars to be used for the
  1 29 nonfederal share of the costs of services provided to minors
  1 30 with mental retardation and to children requiring special
  1 31 education under the medical assistance program to meet the
  1 32 requirements of section 249A.12, subsection 4.  The
  1 33 appropriation in this subsection shall be charged to the
  1 34 property tax relief fund prior to the distribution of moneys
  1 35 from the fund under section 426B.2 and the amount of moneys
  2  1 available for distribution shall be reduced accordingly.
  2  2 However, the appropriation in this subsection shall be
  2  3 considered to be a property tax relief payment for purposes of
  2  4 the combined amount of payments required to achieve fifty
  2  5 percent of the counties' base year expenditures as provided in
  2  6 section 426B.2, subsection 3.  
  2  7                           EXPLANATION
  2  8    This bill provides for state payment of the nonfederal
  2  9 share of medical assistance costs for intermediate care
  2 10 facility and home and community-based waivers for persons with
  2 11 mental retardation services provided under medical assistance
  2 12 to minors and to children requiring special education.  Under
  2 13 Code section 256B.2, "children requiring special education"
  2 14 means persons under age 21 who have a disability in obtaining
  2 15 education because of various types of disabilities.  The bill
  2 16 provides that a county is not to be billed for such costs and
  2 17 the state payment requirement is effective July 1, 1997.
  2 18    The bill includes a conforming amendment to Code section
  2 19 426B.1 which provides an appropriation from the property tax
  2 20 relief fund for costs addressed by the bill.
