1 1 Section 1. NEW SECTION. 22.15 FINANCIAL RECORDS –
1 2 FOUNDATIONS.
1 3 1. As used in this section, "foundation" means any entity
1 4 which is not a government body, but which is established by
1 5 statute or required by statute to be organized under the laws
1 6 of this state, including under chapter 504A, in order to carry
1 7 out a purpose established by statute.
1 8 2. Information stored and preserved by a foundation which
1 9 relates to the financial condition or affairs of the
1 10 foundation, including but not limited to its budget, revenue
1 11 sources, and expenditures, shall be considered a public
1 12 record, and the foundation shall be considered a governmental
1 13 body for purposes of allowing public examination, copying,
1 14 publishing, or disseminating the information as provided under
1 15 this chapter.
1 16 EXPLANATION
1 17 This bill provides that the financial records of
1 18 foundations which are established by statute or required by
1 19 statute to be organized under the laws of this state, in order
1 20 to carry out a purpose established by statute, are public
1 21 records under the open records law. The foundation must allow
1 22 public access to that information as if it were a government
1 23 body.
