  1  4 RELATING TO THE PROHIBITED SALE OF HOME TESTING KITS FOR
  1  5    THE HUMAN IMMUNODEFICIENCY VIRUS.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 126.25, subsection 1, Code 1997, is
  1 10 amended to read as follows:
  1 11    1.  A person shall not advertise for sale, offer for sale,
  1 12 or sell in this state a home testing kit for human
  1 13 immunodeficiency virus antibody or antigen testing.  The Iowa
  1 14 department of public health, in consultation with the board,
  1 15 shall adopt rules to establish what constitutes a home testing
  1 16 kit for the purposes of this section.
