1 2 1997, is amended by striking the paragraph.
1 3 Sec. 2. Section 453A.56, Code 1997, is amended by striking
1 4 the section and inserting in lieu thereof the following:
1 5 453A.56 LOCAL LAWS AND REGULATIONS – ENFORCEMENT.
1 6 A city or county may adopt local laws and regulations
1 7 specifically targeted to reduce or eliminate access to, sale
1 8 to, or use of cigarettes or tobacco products by persons under
1 9 eighteen years of age.
1 10 EXPLANATION
1 11 The bill removes the provisions of the Code that provide
1 12 for the superseding of local laws and regulations by state law
1 13 and regulations relating to smoking prohibitions and
1 14 cigarettes and tobacco products. The bill also authorizes
1 15 cities and counties to adopt laws and regulations which are
1 16 specifically targeted to reduce or eliminate access to, sale
1 17 to, or use of cigarettes or tobacco products by persons under
1 18 18 years of age.
