  1  1    Section 1.  NEW SECTION.  261.110  IOWA TRIBUTE TUITION
  1  2 GRANTS.
  1  3    1.  An Iowa tribute tuition grant may be awarded to a
  1  4 child, whether a resident of this state or not, of a public
  1  5 safety employee or volunteer killed in the line of duty.
  1  6    2.  Eligibility for a tuition grant under this section
  1  7 shall be determined upon application to the commission, whose
  1  8 decision is final, and admission of the applicant to a
  1  9 community college or institution of higher learning under the
  1 10 control of the state board of regents.
  1 11    3.  Grants shall be awarded on an annual basis and shall be
  1 12 credited by the institution against the student's tuition at
  1 13 the beginning of each semester, trimester, or quarter, in
  1 14 equal installments, upon certification by the institution that
  1 15 the student is admitted and attending the institution.
  1 16    4.  An eligible full-time student may receive tribute
  1 17 tuition grants for not more than eight semesters of
  1 18 undergraduate study or the trimester or quarter equivalent.
  1 19 An eligible part-time student may receive tribute tuition
  1 20 grants for not more than sixteen semesters of undergraduate
  1 21 study or the trimester or quarter equivalent.  The grant
  1 22 amount is limited to an amount equal to the resident tuition
  1 23 rate of the institution to which the eligible student is
  1 24 admitted and attending.  "Full-time student" means an
  1 25 individual who is enrolled at a community college or board of
  1 26 regents university for at least twelve semester hours or the
  1 27 trimester or quarter equivalent.  "Part-time student" means an
  1 28 individual who is enrolled at a community college or board of
  1 29 regents university in a course of study including at least
  1 30 three semester hours or the trimester or quarter equivalent of
  1 31 three semester hours.
  1 32    5.  When used in this section, "public safety employee or
  1 33 volunteer killed in the line of duty" means a person whose
  1 34 death occurred in the performance of any act which is within
  1 35 the scope of the lawful duty or authority of the person while
  2  1 paid or volunteering in any of the following capacities in
  2  2 this state:
  2  3    a.  A peace officer as defined in section 801.4.
  2  4    b.  A law enforcement officer as defined in section 80B.3.
  2  5    c.  A reserve peace officer as defined in section 80D.1A.
  2  6    d.  A fire fighter as defined in section 411.1.
  2  7    e.  A volunteer fire fighter as defined in section 85.61.
  2  8    f.  An airport fire fighter employed by the military
  2  9 division of the department of public defense.
  2 10    6.  The college student aid commission shall adopt rules
  2 11 pursuant to chapter 17A to administer this section.
  2 12    7.  There is appropriated from the general fund of the
  2 13 state to the college student aid commission for each fiscal
  2 14 year an amount sufficient for the purpose of awarding of
  2 15 tribute tuition grants as provided in this section.
  2 16    Sec. 2.  APPLICABILITY DATE.  This Act applies to the death
  2 17 of a public safety employee or volunteer which occurs on or
  2 18 after July 1, 1997.  
  2 19                           EXPLANATION
  2 20    This bill provides for the awarding of an Iowa tribute
  2 21 tuition grant to a child, whether a resident of this state or
  2 22 not, of a public safety employee or volunteer killed in the
  2 23 line of duty on or after July 1, 1997.  The bill defines a
  2 24 "public safety employee or volunteer killed in the line of
  2 25 duty" as a person whose death occurred in the performance of
  2 26 any act which is within the scope of the lawful duty or
  2 27 authority of the person while paid or volunteering in any of
  2 28 the following capacities in this state:  a peace officer, a
  2 29 law enforcement officer, a reserve peace officer, a fire
  2 30 fighter, a volunteer fire fighter, or an airport fire fighter
  2 31 employed by the military division of the department of public
  2 32 defense.
  2 33    Grant eligibility is determined by the commission and upon
  2 34 admission to a community college or institution of higher
  2 35 learning under the control of the state board of regents.  The
  3  1 grant amount is limited to payment of the in-state tuition
  3  2 rate and an eligible student may receive tuition grants for
  3  3 not more than eight semesters of undergraduate study or the
  3  4 trimester or quarter equivalent.  An eligible part-time
  3  5 resident student may receive tuition grants for not more than
  3  6 16 semesters of undergraduate study or the trimester or
  3  7 quarter equivalent.
  3  8    The bill provides for a standing unlimited appropriation
  3  9 from the general fund of the state to pay for the awarding of
  3 10 tribute tuition grants.
