PAG LIN 1 1 SENATE FILE 131 1 2 1 3 AN ACT 1 4 RELATING TO FRAUDULENT PRACTICES INVOLVING FAMILY 1 5 INVESTMENT AND MEDICAL ASSISTANCE PROGRAM BENEFITS 1 6 AND MAKING PENALTIES APPLICABLE. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 1 11 Section 1. Section 239.14, Code 1997, is amended to read 1 12 as follows: 1 13 239.14 FRAUDULENTACTSPRACTICES. 1 14WhoeverA person who obtains,orattempts to obtain, or 1 15 aids or abets any person to obtain, by means of a willfully 1 16 false statement or representation, by knowingly failing to 1 17 disclose a material fact, or by impersonation, or any 1 18 fraudulent device, any assistance under this chapter to which 1 19 the recipient is not entitled,shall be guilty ofcommits a 1 20 fraudulent practice. 1 21 Sec. 2. Section 239.17, Code 1997, is amended to read as 1 22 follows: 1 23 239.17 RECOVERY OF ASSISTANCE OBTAINED BY FRAUDULENTACT1 24 PRACTICE. 1 25 A person who obtains,orattempts to obtain, or aids or 1 26 abets any person to obtain, by means of a willfully false 1 27 statement or representation, by knowingly failing to disclose 1 28 a material fact, or by impersonation or any fraudulent device, 1 29 assistance to which the recipient is not entitled, is 1 30 personally liable for the amount of assistance thus obtained. 1 31 The amount of the assistance may be recovered from the 1 32 offender or the offender's estate in an action brought or by 1 33 claim filed in the name of the state and the recovered funds 1 34 shall be deposited in the family investment program account. 1 35 The action or claim filed in the name of the state shall not 2 1 be considered an election of remedies to the exclusion of 2 2 other remedies. 2 3 Sec. 3. Section 249A.7, unnumbered paragraph 1, Code 1997, 2 4 is amended to read as follows: 2 5 A person who obtains assistance or payments for medical 2 6 assistance under this chapter bymisrepresentation or failure,2 7with fraudulent intent, to bring forth all the factsknowingly 2 8 making or causing to be made, a false statement or a 2 9 misrepresentation of a material fact or by knowingly failing 2 10 to disclose a material fact required of an applicant for aid 2 11 under the provisions of this chapter and a person who 2 12 knowingly makes or causes to be made, a falsestatements2 13 statement or a misrepresentation of a material fact or 2 14 knowingly fails to disclose a material fact concerning the 2 15 applicant's eligibility for aid under this chaptershall be2 16guilty ofcommits a fraudulent practice. 2 17 Sec. 4. Section 249A.8, Code 1997, is amended to read as 2 18 follows: 2 19 249A.8 FRAUDULENT PRACTICE. 2 20 A person who knowingly makes or causes to be made false 2 21 statements or misrepresentations of material facts or 2 22 knowingly fails to disclose material facts in application for 2 23 payment of services or merchandise rendered or purportedly 2 24 rendered by a provider participating in the medical assistance 2 25 program under this chapteris guilty ofcommits a fraudulent 2 26 practice. 2 27 2 28 2 29 2 30 MARY E.
