1 1 Section 1. NEW SECTION. 147.161 HYPNOTHERAPY.
1 2 1. As used in this section, unless the context otherwise
1 3 requires:
1 4 a. "Hypnosis" means an artificially induced trance-like
1 5 state, resembling sleep, characterized by heightened
1 6 susceptibility to suggestion.
1 7 b. "Hypnotherapy" means the use of hypnosis as a treatment
1 8 modality.
1 9 2. Only individuals licensed pursuant to section 147.2 to
1 10 engage in the practice of medicine and surgery, osteopathic
1 11 medicine and surgery, psychology, or dentistry may perform
1 12 hypnotherapy as defined in subsection 1. Individuals
1 13 administering hypnotherapy, or representing to the public that
1 14 they administer hypnotherapy, other than those licensed to
1 15 engage in the practice of medicine and surgery, osteopathic
1 16 medicine and surgery, psychology, or dentistry, shall be
1 17 subject to penalty as prescribed in section 147.86.
1 18 3. This section shall not apply to the administration of
1 19 hypnosis for purposes of recreation, entertainment, or
1 20 demonstration. Upon complaint, the department shall determine
1 21 whether the administration of hypnosis shall be characterized
1 22 as hypnotherapy and subject to the provisions of this section,
1 23 or whether the administration of hypnosis shall be
1 24 characterized as recreational in nature.
1 25 EXPLANATION
1 26 This bill establishes the definition of the term
1 27 "hypnosis", and provides that "hypnotherapy" refers to the use
1 28 of hypnosis as a treatment modality. The bill further
1 29 provides that only individuals licensed pursuant to Code
1 30 section 147.2 to engage in the practice of medicine and
1 31 surgery, osteopathic medicine and surgery, psychology, or
1 32 dentistry shall be authorized to administer hypnotherapy.
1 33 Individuals not so licensed shall be subject to the penalty
1 34 provisions of Code section 147.86. The bill exempts
1 35 individuals who administer hypnosis for recreational purposes
2 1 from the provisions of this section.
