PAG LIN 1 1 Section 1. Section 455A.1, Code l997, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 0A. "Council" means the deer population 1 4 control council created under section 455A.12. 1 5 Sec. 2. Section 455A.5, subsection 6, Code l997, is 1 6 amended by adding the following new paragraph: 1 7 NEW PARAGRAPH. g. Receive recommendations of the deer 1 8 population control council and implement deer population 1 9 control programs to provide a balance to the interests of deer 1 10 hunting, general recreation, forestry preservation, 1 11 agriculture, and highway safety. 1 12 Sec. 3. NEW SECTION. 455A.12 DEER POPULATION CONTROL 1 13 COUNCIL – MEMBERSHIP, POWERS AND DUTIES, COMPENSATION. 1 14 1. A deer population control council is created, which 1 15 consists of seven members appointed by the governor for 1 16 staggered terms of six years beginning and ending as provided 1 17 in section 69.19. The council members are subject to senate 1 18 confirmation. The members shall be electors of the state. 1 19 The membership of the council shall be as follows: 1 20 a. Two members shall be persons actively engaged in 1 21 farming. 1 22 b. One member shall be an officer or employee of the 1 23 forests and forestry division of the department. 1 24 c. One member shall be an officer or employee of the fish 1 25 and wildlife division of the department. 1 26 d. One member shall be an officer or employee of the state 1 27 department of transportation. 1 28 e. One member shall be actively engaged in the casualty 1 29 insurance industry. 1 30 f. One member shall be an elector of the state. 1 31 2. A vacancy on the council shall be filled for the 1 32 unexpired term in the same manner as the original appointment 1 33 was made. 1 34 3. The members of the council shall be reimbursed for 1 35 actual and necessary travel and related expenses incurred in 2 1 the discharge of official duties. A member who is not a state 2 2 officer or employee may also be eligible to receive 2 3 compensation as provided in section 7E.6. 2 4 4. The council shall hold an organizational meeting within 2 5 thirty days of the beginning of a new regular term for one or 2 6 more of its members. The council shall organize by electing a 2 7 chairperson, vice chairperson, secretary, and any other 2 8 officers as desired. The council shall meet at least 2 9 quarterly throughout the year. 2 10 5. Except as otherwise provided by law, the council shall 2 11 do all the following: 2 12 a. Determine the extent of crop and tree damage caused by 2 13 deer throughout the state. 2 14 b. Determine the extent of loss of human life and property 2 15 damage caused by accidents involving vehicles and deer. 2 16 c. Make recommendations annually to the natural resource 2 17 commission regarding deer management which take into 2 18 consideration both a biological balance and a recognition of 2 19 damage caused by deer to crops, forests, and forestry 2 20 restoration, and accidents involving deer and vehicles. 2 21 d. Adopt rules as necessary to administer the requirements 2 22 of this section. 2 23 6. The department shall provide the necessary staff for 2 24 the council to carry out its duties. 2 25 Sec. 4. Section 481A.10A, Code l997, is repealed. 2 26 EXPLANATION 2 27 This bill creates a deer population control council within 2 28 the department of natural resources. The deer population 2 29 control council has seven members: two engaged in farming, 2 30 one associated with the casualty insurance industry, one 2 31 member associated with the forests and forestry division of 2 32 the department of natural resources, one member associated 2 33 with the fish and wildlife division of the department of 2 34 natural resources, one member associated with the state 2 35 department of transportation, and one member who is an elector 3 1 of the state. The council members will serve six-year, 3 2 staggered terms of office. The duties of the council are to 3 3 collect and study information related to crop damage, tree 3 4 damage, loss of life, and property damage caused by the deer 3 5 population. The council is also to make recommendations to 3 6 the natural resource commission to develop and implement 3 7 programs to manage the deer population so as to provide a 3 8 balance among the interests of deer hunting, other 3 9 recreational interests, forestry preservation, agriculture, 3 10 and highway safety. 3 11 The bill also repeals section 481A.10A which created a 3 12 farmer advisory committee appointed by the director of the 3 13 department of natural resources to provide information to the 3 14 department regarding crop and tree damage caused by deer, wild 3 15 turkey, and predators. 3 16 LSB 1248SS 77 3 17 tj/sc/14
