PAG LIN 1 1 SENATE FILE 80 1 2 1 3 AN ACT 1 4 RELATING TO POLICE BICYCLES. 1 5 1 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 7 1 8 Section 1. Section 321.231, subsection 3, Code 1997, is 1 9 amended to read as follows: 1 10 3. The driver of a fire department vehicle, police 1 11 vehicle, or ambulance, or a peace officer riding a police 1 12 bicycle in the line of duty may do any of the following: 1 13 a. Proceed past a red or stop signal or stop sign, but 1 14 only after slowing down as may be necessary for safe 1 15 operation. 1 16 b. Exceed the maximum speed limits so long as the driver 1 17 does not endanger life or property. 1 18 Sec. 2. Section 321.234, subsection 2, Code 1997, is 1 19 amended to read as follows: 1 20 2. A person, including a peace officer, riding a bicycle 1 21 on the highway is subject to the provisions of this chapter 1 22 and has all the rights and duties under this chapter 1 23 applicable to the driver of a vehicle, except those provisions 1 24 of this chapter which by their nature can have no application 1 25 or those provisions for which specific exceptions have been 1 26 set forth regarding police bicycles. 1 27 Sec. 3. Section 321.397, Code 1997, is amended to read as 1 28 follows: 1 29 321.397 LAMPS ON BICYCLES. 1 30 Every bicycle shall be equipped with a lamp on the front 1 31 exhibiting a white light, at the times specified in section 1 32 321.384 visible from a distance of at least three hundred feet 1 33 to the front and with a lamp on the rear exhibiting a red 1 34 light visible from a distance of three hundred feet to the 1 35 rear; except that a red reflector meeting the requirements of 2 1 this chapter may be used in lieu of a rear light. A peace 2 2 officer riding a police bicycle is not required to use either 2 3 front or rear lamps if duty so requires. 2 4 Sec. 4. Section 321.434, Code 1997, is amended to read as 2 5 follows: 2 6 321.434 BICYCLE SIRENS OR WHISTLES. 2 7NoA bicycle shall not be equipped withnor shall anyand a 2 8 person shall not use upon a bicycle any siren or whistle. 2 9 This section shall not apply to bicycles ridden by peace 2 10 officers in the line of duty. 2 11 2 12 2 13 2 14 MARY E.
