1 1 Section 1. Section 39.9, Code 1997, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. A person shall not be elected
1 4 for a term as secretary of agriculture if the term would
1 5 result in more than a total of twelve years of service or
1 6 three four-year terms as secretary of agriculture. If a
1 7 person is elected or appointed to serve a portion of a term to
1 8 which some other person was elected or appointed but that
1 9 person died in office or resigned from office or was otherwise
1 10 removed from office, those years served shall not be included
1 11 in the terms of office or total years of service.
1 12 Sec. 2. This Act takes effect upon ratification of an
1 13 amendment to the Constitution of the State of Iowa limiting to
1 14 three terms, or twelve years of service, persons elected to
1 15 the offices of governor, lieutenant governor, attorney
1 16 general, secretary of state, auditor of state, and treasurer
1 17 of state, and as members of the Iowa senate and limiting to
1 18 six terms, or twelve years of service, persons elected as
1 19 members of the Iowa house of representatives.
1 20 Sec. 3. This Act applies to terms of office beginning on
1 21 or after January 1 following the effective date of this Act.
1 22 EXPLANATION
1 23 This bill provides that a person elected to the office of
1 24 Iowa secretary of agriculture is limited to no more than three
1 25 terms or 12 years of service. Partial terms are not included
1 26 in the number of terms or years of service.
1 27 The bill takes effect upon ratification of an amendment to
1 28 the Iowa Constitution limiting to three terms the terms of the
1 29 governor, lieutenant governor, attorney general, secretary of
1 30 state, auditor of state, treasurer of state, and members of
1 31 the Iowa senate and limiting to six terms the terms of members
1 32 of the Iowa house of representatives. The bill applies to
1 33 terms of office beginning on or after January 1 following the
1 34 effective date of the bill.
