1 4 #1. Page 1, by inserting after line 5 the

1 8 "Sec. ___. SCHOOLS FUND. There is appropriated
1 9 from the general fund of the state to the SCHOOLS fund
1 10 for the fiscal year beginning July 1, 1997, and ending
1 11 June 30, 1998, the following amount, or so much
1 12 thereof as is necessary, to be used for the purpose
1 13 designated:
1 14 For use as provided in chapter 257D, as enacted by
1 15 this Act:

1 23 "Sec. 300. NEW SECTION. 257D.1 TITLE.
1 24 This chapter may be cited as the "Support
1 25 Construction and Habilitation of Our Local Schools
1 26 Act".
1 27 Sec. 400. NEW SECTION. 257D.2 SUPPORT
1 28 CONSTRUCTION AND HABILITATION OF OUR LOCAL SCHOOLS
1 29 FUND.
1 30 1. a. A support construction and habilitation of
1 31 our local schools (SCHOOLS) fund is created within the
1 32 state treasury under the control of the department of
1 33 education. For the fiscal year beginning July 1,
1 34 1997, and each subsequent fiscal year there shall be
1 35 appropriated from the rebuild Iowa infrastructure fund
1 36 to the SCHOOLS fund all moneys transferred to the
1 37 rebuild Iowa infrastructure fund pursuant to sections
1 38 99E.10 and 99E.20. In addition to moneys appropriated
1 39 from the rebuild Iowa infrastructure fund, the SCHOOLS
1 40 fund shall include any other moneys available to and
1 41 obtained or accepted by the department from the
1 42 federal government or private sources for placement in
1 43 the SCHOOLS fund. The assets of the SCHOOLS fund
1 44 shall be used by the department as provided in
1 45 subsection 2.
1 46 b. Payments of interest, recaptures of grants, or
1 47 repayments of moneys granted shall be deposited in the
1 48 fund. Section 8.33 does not apply to any moneys in
1 49 the fund.
1 50 c. The fund is subject to an annual audit by the
2 1 auditor of state. Moneys in the fund, which may be
2 2 subject to warrants written by the director of revenue
2 3 and finance, shall be drawn upon the written
2 4 requisition of the director of the department of
2 5 education or an authorized representative of the
2 6 director.
2 7 d. As used in this chapter, "vertical
2 8 infrastructure" has the same meaning as in section
2 9 8.57, subsection 5, except that "vertical
2 10 infrastructure" shall not include recreational trails.
2 11 A matching grant shall only be awarded for specific
2 12 vertical infrastructure projects certified to the
2 13 department in the application.
2 14 2. Moneys in the SCHOOLS fund shall be distributed
2 15 to school districts based on the actual enrollment of
2 16 students in the district as certified pursuant to
2 17 section 257.6."
2 18 #4. Page 5, by inserting after line 49 the
2 19 following:

2 21 257D.1 and 257D.2."
