1 1 Amend the House amendment, S-5761, to Senate File
1 2 2345, as amended, passed, and reprinted by the Senate,
1 3 as follows:
1 4 #1. Page 5, by inserting after line 24, the
1 5 following:
1 6 "Sec. ___. Section 600.12A, if enacted by the 1998
1 7 Iowa Acts, Senate File 2338, is amended by adding the
1 8 following new subsection:
1 9 NEW SUBSECTION. 1A. If the person to be adopted
1 10 dies following termination of the parental rights of
1 11 the person's biological parents but prior to the
1 12 filing of an adoption petition, the person who was the
1 13 guardian or custodian of the person to be adopted
1 14 prior to the person's death or the person who was in a
1 15 parent-child relationship with the person to be
1 16 adopted prior to the person's death may file an
1 17 adoption petition and the court in the interest of
1 18 justice may waive any other procedures or requirements
1 19 related to the adoption, proceed to the adoption
1 20 hearing, and issue a final adoption decree, unless any
1 21 person to whom notice is to be provided pursuant to
1 22 section 600.11 objects to the adoption."
