  1  1    Amend the House amendment, S-5761, to Senate File
  1  2 2345, as amended, passed, and reprinted by the Senate,
  1  3 as follows:
  1  4    #1.  Page 4, by inserting after line 48 the
  1  5 following:
  1  6    "#___.  Page 9, by inserting after line 8 the
  1  7 following:
  1  8    "Sec. ___.  Section 232.147, subsection 3, Code
  1  9 Supplement 1997, is amended by adding the following
  1 10 new paragraph:
  1 11    NEW PARAGRAPH.  h.  If authorized by a subject of a
  1 12 child abuse report as identified in section 235A.15,
  1 13 subsection 2, paragraph "a", or by the parent,
  1 14 guardian, or custodian of a child receiving services
  1 15 or involved in a proceeding under this chapter, to a
  1 16 statewide elected official, as defined in section
  1 17 68B.2, a member of the general assembly, or a designee
  1 18 of the statewide elected official or member of the
  1 19 general assembly.  The purpose of the disclosure shall
  1 20 be for the elected official, member of the general
  1 21 assembly, or designee to monitor compliance of state
  1 22 agencies, officials, and employees with requirements
  1 23 under law and the adequacy of the requirements.  The
  1 24 authorization under this paragraph shall encompass
  1 25 information in the record which is subject to section
  1 26 217.30 or 228.3 and relates to the person providing
  1 27 the authorization or to a child of the person.  The
  1 28 penalties applicable to violations of section 217.30
  1 29 or 228.3 are applicable to unauthorized disclosures of
  1 30 information which are subject to section 217.30 or
  1 31 228.3.
  1 32    Sec. ___.  Section 232.147, subsection 5, Code
  1 33 Supplement 1997, is amended by adding the following
  1 34 new unnumbered paragraph:
  1 35    NEW UNNUMBERED PARAGRAPH.  An individual authorized
  1 36 under subsection 3, paragraph "h", to inspect official
  1 37 juvenile court records, may inspect social records and
  1 38 the contents of the records and the official juvenile
  1 39 court records of cases alleging delinquency shall be
  1 40 disclosed to such individual for the purposes
  1 41 described in subsection 3, paragraph "h".  The
  1 42 authorization under this paragraph shall encompass
  1 43 information in the record which is subject to section
  1 44 217.30 or 228.3 and relates to the person providing
  1 45 the authorization or to a child of the person.  The
  1 46 penalties applicable to violations of section 217.30
  1 47 or 228.3 are applicable to unauthorized disclosures of
  1 48 information which are subject to section 217.30 or
  1 49 228.3."
  1 50    #___.  Page 9, by inserting after line 23 the
  2  1 following:
  2  2    "Sec. ___.  Section 235A.15, subsection 2,
  2  3 paragraph d, Code Supplement 1997, is amended by
  2  4 adding the following new subparagraph:
  2  5    NEW SUBPARAGRAPH.  (6)  If authorized by a subject
  2  6 of a child abuse report as identified in paragraph
  2  7 "a", to a statewide elected official as defined in
  2  8 section 68B.2, a member of the general assembly, or a
  2  9 designee of a statewide elected official or member of
  2 10 the general assembly, to the maximum extent access to
  2 11 the information is available to any other person
  2 12 authorized under this lettered paragraph.  The purpose
  2 13 of the access shall be to monitor compliance of state
  2 14 agencies, officials, and employees with requirements
  2 15 under the law and the adequacy of the requirements.
  2 16 The authorization under this subparagraph shall
  2 17 encompass child abuse information which is subject to
  2 18 section 217.30 or 228.3 and relates to the person
  2 19 providing the authorization or to a child of the
  2 20 person.  The penalties applicable to violations of
  2 21 section 217.30 or 228.3 are applicable to unauthorized
  2 22 disclosures of information which are subject to
  2 23 section 217.30 or 228.3.
  2 24    Sec. ___.  Section 235A.19, subsection 2, paragraph
  2 25 b, Code Supplement 1997, is amended by adding the
  2 26 following new subparagraph:
  2 27    NEW SUBPARAGRAPH.  (8)  To a statewide elected
  2 28 official, a member of the general assembly, or a
  2 29 designee of a statewide elected official or member of
  2 30 the general assembly authorized under section 235A.15,
  2 31 subsection 2, paragraph "d".  The authorization under
  2 32 this subparagraph shall encompass child abuse
  2 33 information which is subject to section 217.30 or
  2 34 228.3 and relates to the person providing the
  2 35 authorization or to a child of the person.  The
  2 36 penalties applicable to violations of section 217.30
  2 37 or 228.3 are applicable to unauthorized disclosures of
  2 38 information which are subject to section 217.30 or
  2 39 228.3.""
