PAG LIN 1 1 Amend House File 2530, as passed by the House, as 1 2 follows: 1 3 #1. Page 1, by inserting before line 1 the 1 4 following: 1 5 "Sec. ___. NEW SECTION. 405A.11 REBUILD OUR 1 6 CITIES AND COUNTIES PROGRAM. 1 7 1. A rebuild our cities and counties (ROCC) fund 1 8 is created in the state treasury. The director of 1 9 revenue and finance shall credit the rebuild our 1 10 cities and counties fund with the moneys appropriated 1 11 to the fund as provided in this section. For purposes 1 12 of this section, "revenues generated by the sales tax" 1 13 means the estimated revenue from the gross receipts 1 14 taxed by the state pursuant to chapter 422, division 1 15 IV, as estimated by the revenue estimating conference 1 16 pursuant to section 8.22A in December preceding the 1 17 fiscal year for which the appropriation provided for 1 18 in this subsection shall be made. The moneys credited 1 19 to the ROCC fund shall be apportioned on a per capita 1 20 basis with an equal share allocated to each person 1 21 residing in the state. The share of each person 1 22 residing in a city shall be paid to the treasurer of 1 23 that city. The share allocated to each person 1 24 residing outside the boundaries of a city shall be 1 25 paid to the county treasurer. The population of each 1 26 city shall be determined by the latest federal census. 1 27 The population of each county shall be determined by 1 28 the last federal census excluding the persons residing 1 29 within the boundaries of each city within the county. 1 30 There is appropriated from the general fund of the 1 31 state to the ROCC fund annually the following amounts 1 32 for the designated fiscal years: 1 33 a. For the fiscal year beginning July 1, 1999, an 1 34 amount equal to two percent of the revenues generated 1 35 by the sales tax. 1 36 b. For subsequent fiscal years beginning with July 1 37 1, 2000, the amount of appropriation shall increase an 1 38 additional two percent of the revenues generated by 1 39 the sales tax if the requirements of subsection 2 are 1 40 met. However, the amount appropriated for a fiscal 1 41 year shall not exceed a total of ten percent of the 1 42 revenues generated by the sales tax. 1 43 2. The additional two percent of revenues 1 44 generated by the sales tax, as specified in subsection 1 45 1, shall be appropriated in a fiscal year only if the 1 46 December revenue estimate for the general fund of the 1 47 state for the next succeeding fiscal year exceeds the 1 48 revenue estimate for the general fund of the state for 1 49 the previous fiscal year by at least four percent. 1 50 3. During the budgeting process for each city and 2 1 county, the governing body of the city or county shall 2 2 request public comment, at a public hearing, on the 2 3 expenditure of the moneys received from the rebuild 2 4 our cities and counties fund. After public comment, 2 5 the governing body shall specify the amount of funds 2 6 which will be used for tax relief, including how the 2 7 tax relief will be accomplished and the amount of 2 8 funds which will be appropriated for specific 2 9 programs." 2 10 2 11 2 12 2 13 ROD HALVORSON 2 14 HF 2530.702 77 2 15 tj/sc/28
