PAG LIN 1 1 Amend Senate File 2292, as amended, passed, and 1 2 reprinted by the Senate, as follows: 1 3 #1. Page 1, by inserting before line 1 the 1 4 following: 1 5 "Section 1. Section 692A.1, subsection 3, 1 6 paragraphs a and b, Code Supplement 1997, are amended 1 7 by striking the paragraphs." 1 8 #2. Page 1, by inserting before line 1, the 1 9 following: 1 10 "Sec. . Section 692A.1, subsection 3, Code 1 11 Supplement 1997, is amended by adding the following 1 12 new paragraph after paragraph h and by relettering 1 13 current paragraphs i through l as paragraphs j through 1 14 m: 1 15 NEW PARAGRAPH. i. Incest committed against a minor. 1 16 Sec. . Section 692A.1, subsection 3, paragraph 1 17 m, Code Supplement 1997, is amended to read as 1 18 follows: 1 19m.n. An indictable offense committed in another 1 20 jurisdiction which would constitute an indictable 1 21 offense under paragraphs "a" through"l""m"." 1 22 #3. Page 1, line 17, by inserting after the word 1 23 "kidnapping," the following: "false imprisonment,". 1 24 #4. Page 11, by inserting after line 30, the 1 25 following: 1 26 "Sec. . MEGAN'S LAW COMPLIANCE DETERMINATION. 1 27 The department of public safety shall submit a request 1 28 to the United States department of justice for a 1 29 determination of whether the failure of a state to 1 30 include as criminal offenses against a minor the 1 31 offenses of kidnapping or false imprisonment of a 1 32 minor, committed by someone other than a parent and 1 33 which do not involve sexual abuse or attempted sexual 1 34 abuse, will result in a state being found not to be in 1 35 compliance with the federal Megan's Law amendment to 1 36 the Jacob Wetterling Crimes Against Children and 1 37 Sexually Violent Offender Registration Act specified 1 38 in section 170101(f) of Pub. L. No. 104-145, 110 Stat. 1 39 1345 (codified at 42 U.S.C. } 14071(f)). If the 1 40 department of public safety receives, as a result of 1 41 the request, an opinion that the failure to include 1 42 those offenses as criminal offenses against a minor 1 43 will cause a state to not be in compliance with the 1 44 federal Megan's Law amendment, the department shall 1 45 seek an exception to the requirement for inclusion of 1 46 those offenses and shall report the information 1 47 regarding the contents of the United States department 1 48 of justice opinion and any results of the exception 1 49 request at the commencement of the session of the 1 50 general assembly which convenes in January of 1999." 2 1 #5.
