1 1 Amend the amendment, S-5556, to House File 667, as
1 2 amended, passed, and reprinted by the House, as
1 3 follows:
1 4 #1. Page 5, by inserting after line 11 the
1 5 following:
1 6 "# . Page 17, by inserting before line 32 the
1 7 following:
1 8 "Sec. ___. Section 17A.15, subsection 3, Code
1 9 1997, is amended to read as follows:
1 10 3. When the presiding officer makes a proposed
1 11 decision, that decision then becomes the final
1 12 decision of the agency without further proceedings
1 13 unless there is an appeal to, or review on motion of,
1 14 the agency within the time provided by rule. On
1 15 appeal from or review of the proposed decision, the
1 16 agency has all the power which it would have in
1 17 initially making the final decision except as it may
1 18 limit the issues on notice to the parties or by rule.
1 19 The agency may review or modify any finding of fact or
1 20 conclusion of law in the proposed decision if the
1 21 agency shows by a preponderance of the evidence that
1 22 the finding of fact or conclusion of law was in error.
1 23 In cases where there is an appeal from a proposed
1 24 decision or where a proposed decision is reviewed on
1 25 motion of the agency, an opportunity shall be afforded
1 26 to each party to file exceptions, present briefs and,
1 27 with the consent of the agency, present oral arguments
1 28 to the agency members who are to render the final
1 29 decision.""
