  1  1    Amend the amendment, S-5468, to Senate File 2391,
  1  2 as amended, passed, and reprinted by the Senate, as
  1  3 follows:
  1  4    #1.  Page 1, by inserting before line 6 the
  1  5 following:
  1  6    "#   .  Page 1, by inserting after line 10 the
  1  7 following:
  1  8    "Sec. 1000.  Section 321.12, Code Supplement 1997,
  1  9 is amended by adding the following new subsection:
  1 10    NEW SUBSECTION.  5.  Notwithstanding subsection 4
  1 11 and section 321J.2, subsection 4, paragraph "a", the
  1 12 six-year time frame in effect until July 1, 1997,
  1 13 shall be used for determining whether an offense is a
  1 14 first, second, or subsequent violation under chapter
  1 15 321J, for offenses committed prior to July 1, 1997.
  1 16 In addition, all revocation periods, minimum periods
  1 17 of ineligibility, and ignition interlock requirements
  1 18 in chapter 321J changed in 1997 Iowa Acts, chapter
  1 19 177, shall apply only to offenses committed on or
  1 20 after July 1, 1997.  For offenses committed prior to
  1 21 July 1, 1997, the revocation periods, minimum periods
  1 22 of ineligibility, and ignition interlock requirements
  1 23 applicable until July 1, 1997, shall apply.""
  1 24    #2.  Page 13, by inserting before line 11 the
  1 25 following:
  1 26    "Sec. ___.  RETROACTIVE APPLICABILITY.  Section
  1 27 1000 of this Act is retroactively applicable to July
  1 28 1, 1997, and is applicable on and after that date.""
  1 29    #3.  Page 14, line 2, by inserting after the word
  1 30 "license," the following:  "reinstating the six-year
  1 31 time frame, certain revocation and ineligibility
  1 32 periods, and certain ignition interlock requirements
  1 33 applicable to operating-while-intoxicated violations
  1 34 committed prior to July 1, 1997,".
  1 35    #4.  By renumbering as necessary.
