  1  1    Amend House File 2539, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  By striking page 33, line 31, through page 34,
  1  4 line 2.
  1  5    #2.  Page 35, by inserting after line 20 the
  1  6 following:
  1  7    "Sec. ___.  DEPARTMENT OF PUBLIC HEALTH.  There is
  1  8 appropriated from the general fund of the state to the
  1  9 department of public health for the fiscal year
  1 10 beginning July 1, 1998, and ending June 30, 1999, the
  1 11 following amount, or so much thereof as is necessary,
  1 12 to be used for the purpose designated:
  1 13    For the state medical examiner and for not more
  1 14 than the following full-time equivalent positions:  
  1 15 .................................................. $    354,703
  1 16 ............................................... FTEs       4.00
  1 17    Any fees collected by the Iowa department of public
  1 18 health for autopsies performed by the office of the
  1 19 state medical examiner shall be deposited in the
  1 20 general fund of the state."
  1 21    #3.  Page 35, by inserting after line 32 the
  1 22 following:
  1 23    "Sec. ___.  Section 691.5, Code 1997, is amended to
  1 24 read as follows:
  1 25    691.5  STATE MEDICAL EXAMINER.
  1 26    The position of state medical examiner is created
  1 27 under the control, direction, and supervision of the
  1 28 commissioner of public safety director of the
  1 29 department of public health.  The commissioner of
  1 30 public safety director of the department of public
  1 31 health may assign the office of the state medical
  1 32 examiner to a division or bureau within the public
  1 33 safety health department.  Other state agencies shall
  1 34 cooperate with the state medical examiner in the use
  1 35 of state-owned facilities when appropriate for the
  1 36 performance of nonadministrative duties of the state
  1 37 medical examiner.  The state medical examiner shall be
  1 38 a physician and surgeon or osteopathic physician and
  1 39 surgeon, be licensed to practice medicine in the state
  1 40 of Iowa, and possess special knowledge in forensic
  1 41 pathology.  The state medical examiner shall be
  1 42 appointed by and serve at the pleasure of the
  1 43 commissioner of public safety director of the
  1 44 department of public health.  The state medical
  1 45 examiner may be a faculty member of the college of
  1 46 medicine or the college of law at the University of
  1 47 Iowa, and any of the examiner's assistants or staff
  1 48 may be members of the faculty or staff of the college
  1 49 of medicine or the college of law at the University of
  1 50 Iowa.
  2  1    Sec. ___.  Section 691.6, subsection 3, Code 1997,
  2  2 is amended to read as follows:
  2  3    3.  To adopt rules pursuant to chapter 17A, and
  2  4 subject to the approval of the commissioner of public
  2  5 safety director of the department of public health,
  2  6 regarding the manner and techniques to be employed
  2  7 while conducting autopsies; the nature, character, and
  2  8 extent of investigations to be made in cases of
  2  9 homicide or suspected homicide necessary to allow a
  2 10 medical examiner to render a full and complete
  2 11 analysis and report; the format and matters to be
  2 12 contained in all reports rendered by medical
  2 13 examiners; and all other things necessary to carry out
  2 14 this section.  All county medical examiners and peace
  2 15 officers are subject to the rules.
  2 16    Sec. ___.  Section 691.7, Code 1997, is amended to
  2 17 read as follows:
  2 18    691.7  COMMISSIONER OR DIRECTOR TO ACCEPT FEDERAL
  2 19 OR PRIVATE GRANTS.
  2 20    The commissioner of public safety may accept
  2 21 federal or private funds or grants to aid in the
  2 22 establishment or operation of the state criminalistics
  2 23 laboratory, and the commissioner of public safety
  2 24 director of the department of public health or the
  2 25 board of regents may accept federal or private funds
  2 26 or grants to aid in the establishment or operation of
  2 27 the position of state medical examiner."
