1 3 #1. Page 2, by inserting after line 23 the
1 4 following:
1 5 "Sec. 111. NEW SECTION. 422.12A INCOME TAX
1 6 CHECKOFF FOR THE ARTS.
1 7 1. A person who files an individual or a joint
1 8 income tax return with the department of revenue and
1 9 finance under section 422.13 may designate one dollar
1 10 or more to be paid to the Iowa state arts council as
1 11 established in section 303.86. If the refund due on
1 12 the return or the payment remitted with the return is
1 13 insufficient to pay the amount designated by the
1 14 taxpayer to the Iowa state arts council, the amount
1 15 designated shall be reduced to the remaining amount of
1 16 the refund or the remaining amount remitted with the
1 17 return. The designation of a contribution to the Iowa
1 18 state arts council under this section is irrevocable.
1 19 2. The director of revenue and finance shall draft
1 20 the income tax form to allow the designation of
1 21 contributions to the Iowa state arts council on the
1 22 tax return. The department, on or before January 31,
1 23 shall transfer the total amount designated on the tax
1 24 form due in the preceding year to an arts fund created
1 25 in the division of arts of the department of cultural
1 26 affairs.
1 27 3. The division of arts may authorize payment from
1 28 the arts fund for purposes of supporting division of
1 29 arts activities.
1 30 4. The department shall adopt rules to implement
1 31 this section. However, before a checkoff pursuant to
1 32 this section shall be permitted, all liabilities on
1 33 the books of the department of revenue and finance and
1 34 accounts identified as owing under section 421.17 and
1 35 the political contribution allowed under section 56.18
1 36 shall be satisfied.
1 37 5. The limitation on income tax return checkoffs
1 38 specified in section 422.12E does not apply to this
1 39 checkoff."
1 40 #2. Page 37, by inserting after line 9 the
1 41 following:
1 42 "___. Section 111 of this Act, establishing
1 43 section 422.12A, applies retroactively to January 1,
1 44 1998, for tax years beginning on or after that date."
