  1  1    Amend House File 2528, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 3, by inserting after line 8 the
  1  4 following:
  1  5    "Sec. ___.  NEW SECTION.  321.178A  DRIVER
  1  6 EDUCATION – TEACHING PARENT.
  1  7    1.  TEACHING PARENT QUALIFICATIONS.  As an
  1  8 alternative to section 321.178, a teaching parent may
  1  9 instruct a student in driver's education courses which
  1 10 meet the requirements of this section, and provides
  1 11 certified evidence that the requirements under this
  1 12 section have been met.
  1 13    2.  DEFINITIONS.  For purposes of this section:
  1 14    a.  "Student" means a person within the custody and
  1 15 control of the teaching parent, who is between the
  1 16 ages of fourteen and twenty-one years of age and who
  1 17 satisfies preliminary licensing requirements of the
  1 18 department.
  1 19    b.  "Teaching parent" means a person who is the
  1 20 parent or guardian of a student, who holds a current
  1 21 valid Iowa license to operate a motor vehicle, and who
  1 22 has a student enrolled in an accredited nonpublic
  1 23 school that does not offer driver's education at such
  1 24 school or who is either a person providing competent
  1 25 instruction or competent private instruction pursuant
  1 26 to section 299A.2 or 299A.3.
  1 27    3.  COURSE OF INSTRUCTION.  A driver education
  1 28 course administered by a teaching parent shall consist
  1 29 at a minimum of the following:
  1 30    a.  Thirty clock hours of classroom instruction.
  1 31    b.  Forty hours of street or highway driving
  1 32 including four hours of driving after sunset and
  1 33 before sunrise while accompanied by a parent or
  1 34 guardian.
  1 35    c.  Four hours of classroom instruction concerning
  1 36 substance abuse.
  1 37    d.  Twenty minutes of instruction concerning
  1 38 railroad crossing safety.
  1 39    e.  Instruction relating to becoming an organ donor
  1 40 under the uniform anatomical gift Act.
  1 41    The content of the course of instruction required
  1 42 under this subsection shall be equivalent to that
  1 43 required under section 321.178.  However, the course
  1 44 requirements, reference and study materials, manuals,
  1 45 study aids, workbooks, physical requirements,
  1 46 classroom dimensions, type of chalkboards, extra
  1 47 vehicle safety equipment, extra foot brake, cut-off
  1 48 switches, and extra mirrors required for instruction
  1 49 under section 321.178 shall not be required for the
  1 50 course of instruction provided under this section.
  2  1    4.  COURSE COMPLETION.  Upon completion of a course
  2  2 under this section, the teaching parent shall document
  2  3 or provide evidence showing substantial statutory
  2  4 compliance with the requirements of subsection 3 and
  2  5 certify by affidavit to the department, or county
  2  6 treasurer when applicable, that the course has been
  2  7 completed.  Documentation shall include the following:
  2  8    a.  An affidavit attesting to satisfactory
  2  9 completion of course work and street or highway
  2 10 driving instruction.
  2 11    b.  A listing of subjects presented in classroom
  2 12 training.
  2 13    c.  Copies of written tests completed by the
  2 14 student.
  2 15    d.  A statement of the number of classroom hours of
  2 16 instruction.
  2 17    e.  A log of street or highway driving instruction
  2 18 including the dates when the lessons were conducted,
  2 19 the student's and the parent's name and initials noted
  2 20 next to each entry, notes on driving activities,
  2 21 including a list of driving deficiencies and
  2 22 improvements, and the duration of the driving time for
  2 23 each session.
  2 24    5.  INTERMEDIATE LICENSE.  Any student who
  2 25 successfully completes a driver education course as
  2 26 provided in this section and who passes a driving
  2 27 skills test to be administered by the department and
  2 28 is otherwise qualified under section 321.180B,
  2 29 subsection 2, shall be eligible for an intermediate
  2 30 license pursuant to section 321.180B.  Such a student
  2 31 is not required to file an affidavit with the
  2 32 department regarding completion of street or highway
  2 33 driving with a parent or guardian under section
  2 34 321.180B, subsection 2, and the hours of driving
  2 35 required under subsection 3 shall substitute for any
  2 36 hours of driving required under section 321.180B,
  2 37 subsection 2.
  2 38    6.  FULL LICENSE.  A student must comply with
  2 39 section 321.180B, subsection 4, to be eligible for a
  2 40 full driver's license pursuant to section 321.180B."
