1 1 Amend Senate File 2360 as follows:
1 2 #1. Page 3, by inserting after line 17 the
1 3 following:
1 4 "Sec. 111. NEW SECTION. 422.12A INCOME TAX
1 5 CHECKOFF FOR THE ARTS.
1 6 1. A person who files an individual or a joint
1 7 income tax return with the department of revenue and
1 8 finance under section 422.13 may designate one dollar
1 9 or more to be paid to the Iowa state arts council as
1 10 established in section 303.86. If the refund due on
1 11 the return or the payment remitted with the return is
1 12 insufficient to pay the amount designated by the
1 13 taxpayer to the Iowa state arts council, the amount
1 14 designated shall be reduced to the remaining amount of
1 15 the refund or the remaining amount remitted with the
1 16 return. The designation of a contribution to the Iowa
1 17 state arts council under this section is irrevocable.
1 18 2. The director of revenue and finance shall draft
1 19 the income tax form to allow the designation of
1 20 contributions to the Iowa state arts council on the
1 21 tax return. The department, on or before January 31,
1 22 shall transfer the total amount designated on the tax
1 23 form due in the preceding year to an arts fund created
1 24 in the division of arts of the department of cultural
1 25 affairs.
1 26 3. The division of arts may authorize payment from
1 27 the arts fund for purposes of supporting division of
1 28 arts activities.
1 29 4. The department shall adopt rules to implement
1 30 this section. However, before a checkoff pursuant to
1 31 this section shall be permitted, all liabilities on
1 32 the books of the department of revenue and finance and
1 33 accounts identified as owing under section 421.17 and
1 34 the political contribution allowed under section 56.18
1 35 shall be satisfied."
1 36 #2. Page 38, by inserting after line 4 the
1 37 following:
1 38 "___. Section 111 of this Act, establishing
1 39 section 422.12A, applies retroactively to January 1,
1 40 1998, for tax years beginning on or after that date."
