1 1 Amend Senate File 2338 as passed by the Senate, as
1 2 follows:
1 3 #1. Page 1, by inserting before line 1, the
1 4 following:
1 5 "Section 1. NEW SECTION. 600.12A DEATH OF PERSON
1 6 TO BE ADOPTED – PROCESS FOR FINAL ADOPTION DECREE.
1 7 1. If the person to be adopted dies following the
1 8 filing of an adoption petition pursuant to section
1 9 600.3, but prior to issuance of a final adoption
1 10 decree pursuant to section 600.13, the court may waive
1 11 any investigations and reports required pursuant to
1 12 section 600.8 that remain uncompleted, waive the
1 13 minimum residence requirements pursuant to section
1 14 600.10, proceed to the adoption hearing, and issue a
1 15 final adoption decree, unless any person to whom
1 16 notice is to be provided pursuant to section 600.11
1 17 objects to the adoption.
1 18 2. A final adoption decree issued pursuant to this
1 19 section terminates any parental rights existing prior
1 20 to the time of its issuance and establishes the
1 21 parent-child relationship between the adoption
1 22 petitioner and the person adopted. However, the final
1 23 adoption decree does not confer any rights on the
1 24 adoption petitioner to the estate of the adopted
1 25 person and does not confer any rights on the adopted
1 26 person to the estate of the adoption petitioner."
1 27 #2. Page 1, by striking line 23 and inserting the
1 28 following: "defined in section 238.2, a person making
1 29 an independent placement as defined in section 600A.2,
1 30 or an".
1 31 #3. Page 1, by inserting after line 35 the
1 32 following:
1 33 "Sec. ___. EFFECTIVE DATE. Section 1, creating
1 34 section 600.12A, being deemed of immediate importance,
1 35 takes effect upon enactment."
1 36 #4. Title page, line 1, by inserting after the
1 37 word "to" the following: "adoptions including the
1 38 process for adoption of a deceased person and relating
1 39 to".
1 40 #5. Title page, line 2, by inserting after the
1 41 word "adoptions" the following: "and providing an
1 42 effective date".
1 43 #6. By renumbering, relettering, or redesignating
1 44 and correcting internal references as necessary.
