  1  1    Amend Senate File 2345 as follows:
  1  2    #1.  Page 1, by inserting after line 9 the
  1  3 following:
  1  4    "Sec. ___.  Section 232.2, subsection 4, Code
  1  5 Supplement 1997, is amended by adding the following
  1  6 new paragraph:
  1  7    NEW PARAGRAPH.  h.  If reasonable efforts to place
  1  8 a child for adoption or with a guardian are made
  1  9 concurrently with reasonable efforts as defined in
  1 10 section 232.102, the concurrent goals and timelines
  1 11 may be identified.  Concurrent case permanency plan
  1 12 goals for reunification, and for adoption or for other
  1 13 permanent out-of-home placement of a child shall not
  1 14 be considered inconsistent in that the goals reflect
  1 15 divergent possible outcomes for a child in an out-of-
  1 16 home placement."
  1 17    #2.  Page 1, by inserting after line 25 the
  1 18 following:
  1 19    "Sec. ___.  Section 232.78, subsection 5, Code
  1 20 1997, is amended to read as follows:
  1 21    5.  Any person who may file a petition under this
  1 22 chapter may apply for, or the court on its own motion
  1 23 may issue, an order for temporary removal under this
  1 24 section.  An appropriate person designated by the
  1 25 court shall confer with a person seeking the removal
  1 26 order, shall make every reasonable effort to inform
  1 27 the parent or other person legally responsible for the
  1 28 child's care of the application, and shall make such
  1 29 inquiries as will aid the court in disposing of such
  1 30 application.  Any order entered under this section
  1 31 authorizing temporary removal of a child shall include
  1 32 a statement informing the child's parent that the
  1 33 consequences of a permanent removal may include
  1 34 termination of the parent's rights with respect to the
  1 35 child.
  1 36    Sec. ___.  Section 232.91, Code Supplement 1997, is
  1 37 amended by adding the following new subsection:
  1 38    NEW SUBSECTION.  3.  Any person who is entitled
  1 39 under section 232.88 to receive notice of a hearing
  1 40 concerning a child shall be given the opportunity to
  1 41 be heard in any other review or hearing involving the
  1 42 child.
  1 43    Sec. ___.  Section 232.95, subsection 2, paragraph
  1 44 a, unnumbered paragraph 2, Code 1997, is amended to
  1 45 read as follows:
  1 46    If removal is ordered, the order shall, in
  1 47 addition, contain a statement that removal from the
  1 48 home is the result of a determination that
  1 49 continuation therein would be contrary to the welfare
  1 50 of the child, and that reasonable efforts have been
  2  1 made to prevent or eliminate the need for removal of
  2  2 the child from the child's home.  The order shall also
  2  3 include a statement informing the child's parent that
  2  4 the consequences of a permanent removal may include
  2  5 termination of the parent's rights with respect to the
  2  6 child.
  2  7    Sec. ___.  Section 232.96, subsection 10, Code
  2  8 1997, is amended to read as follows:
  2  9    10.  If the court enters an order adjudicating the
  2 10 child to be a child in need of assistance, the court,
  2 11 if it has not previously done so, may issue an order
  2 12 authorizing temporary removal of the child from the
  2 13 child's home as set forth in section 232.95,
  2 14 subsection 2, paragraph "a", pending a final order of
  2 15 disposition.  The order shall include a statement
  2 16 informing the child's parent that the consequences of
  2 17 a permanent removal may include termination of the
  2 18 parent's rights with respect to the child."
  2 19    #3.  Page 1, by inserting after line 34 the
  2 20 following:
  2 21    "Sec. ___.  Section 232.102, Code Supplement 1997,
  2 22 is amended by adding the following new subsection:
  2 23    NEW SUBSECTION.   7A.  Any order transferring
  2 24 custody to the department or an agency shall include a
  2 25 statement informing the child's parent that the
  2 26 consequences of a permanent removal may include the
  2 27 termination of the parent's rights with respect to the
  2 28 child."
  2 29    #4.  By striking page 1, line 35, through page 2,
  2 30 line 9 and inserting the following:
  2 31    "Sec. ___.  Section 232.102, subsection 8,
  2 32 paragraph c, Code Supplement 1997, is amended to read
  2 33 as follows:"
  2 34    #5.  Page 4, line 30, by striking the words "or
  2 35 for" and inserting the following:  "for".
  2 36    #6.  Page 4, line 31, by inserting after the figure
  2 37 "232.79," the following:  "or for an order entered
  2 38 under section 232.102, for which the court has not
  2 39 waived reasonable efforts requirements,".
  2 40    #7.  Page 4, line 32, by striking the word
  2 41 "fourteen" and inserting the following:  "twelve".
  2 42    #8.  By striking page 4, line 34, through page 5,
  2 43 line 2.
  2 44    #9.  Page 5, line 3, by striking the figure "(3)"
  2 45 and inserting the following:  "(2)".
  2 46    #10.  Page 5, lines 28 through 31, by striking the
  2 47 words "When such order places the child in the custody
  2 48 of the department for the purpose of long-term foster
  2 49 care placement in a facility, the The" and inserting
  2 50 the following:  "When such the order places the child
  3  1 in the custody of the department for the purpose of
  3  2 long-term foster care placement in a facility, the".
  3  3    #11.  Page 7, by inserting after line 7 the
  3  4 following:
  3  5    "Sec. ___.  Section 232.117, subsection 4, Code
  3  6 1997, is amended to read as follows:
  3  7    4.  If after a hearing the court does not order the
  3  8 termination of parental rights but finds that there is
  3  9 clear and convincing evidence that the child is a
  3 10 child in need of assistance, under section 232.2,
  3 11 subsection 6, due to the acts or omissions of one or
  3 12 both of the child's parents the court may adjudicate
  3 13 the child to be a child in need of assistance and may
  3 14 enter an order in accordance with the provisions of
  3 15 sections section 232.100, 232.101, or 232.102, or
  3 16 232.104."
