  1  1    Amend Senate File 2042 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  Section 6B.14, unnumbered paragraph 1,
  1  5 Code 1997, is amended to read as follows:
  1  6    The commissioners shall, at the time fixed in the
  1  7 aforesaid notices, view the land sought to be
  1  8 condemned and assess the damages which the owner will
  1  9 sustain by reason of the appropriation; and they shall
  1 10 file their written report with the sheriff.  At the
  1 11 request of the condemner or the condemnee, the
  1 12 commission shall divide the damages into parts to
  1 13 indicate the value of any dwelling, the value of the
  1 14 land and improvements other than a dwelling, and the
  1 15 value of any additional damages.  If the land is being
  1 16 condemned for economic development purposes, the
  1 17 commissioners, in assessing the damages, shall value
  1 18 the land according to the use of the land intended by
  1 19 the condemner.  The appraisement and return may be in
  1 20 parcels larger than forty acres belonging to one
  1 21 person and lying in one tract, unless the agent or
  1 22 attorney of the applicant, or the commissioners, have
  1 23 actual knowledge that the tract does not belong wholly
  1 24 to the person in whose name it appears of record; and
  1 25 in case of such knowledge, the appraisement shall be
  1 26 made of the different portions as they are known to be
  1 27 owned."
