  1  1    Amend Senate File 2366 as follows:
  1  2    #1.  By striking page 4, line 31, through page 6,
  1  3 line 15 and inserting the following:
  1  4    "Sec. ___.  NEW SECTION.  256.44  TALENTED AND
  1  5 GIFTED GRANT PROGRAM – APPROPRIATION – DISTRIBUTION.
  1  6    1.  There is appropriated from the general fund of
  1  7 the state to the department of education for the
  1  8 fiscal year beginning July 1, 1998, and for each
  1  9 succeeding fiscal year, the sum of three hundred
  1 10 thousand dollars for a talented and gifted grant
  1 11 program for kindergarten through grade three.
  1 12    2.  The department shall establish a talented and
  1 13 gifted grant program to provide for the awarding of
  1 14 grant moneys, appropriated pursuant to subsection 1,
  1 15 to public school districts for purposes of increasing
  1 16 the numbers or reach of programs for children enrolled
  1 17 in kindergarten through grade three who are talented
  1 18 and gifted as defined in section 257.44.
  1 19    3.  For each fiscal year for which moneys are
  1 20 appropriated in subsection 1, the amount of moneys
  1 21 allocated to individual school districts shall be in
  1 22 the proportion that the basic enrollment of the
  1 23 district bears to the sum of the basic enrollments of
  1 24 all school districts in the state for the budget year.
  1 25 The Iowa braille and sight saving school, the state
  1 26 school for the deaf, and the Price laboratory school
  1 27 at the university of northern Iowa shall annually
  1 28 certify their basic enrollments to the department of
  1 29 education by October 1.
  1 30    4.  For each year for which an appropriation is
  1 31 made to the talented and gifted grant program, the
  1 32 department of education shall notify the department of
  1 33 revenue and finance of the amount to be paid to each
  1 34 school district based upon the distribution formula
  1 35 set forth for the appropriation made pursuant to this
  1 36 section.  The allocation to each school district under
  1 37 this section shall be made in one payment on or about
  1 38 October 15 of the fiscal year for which the
  1 39 appropriation is made, taking into consideration the
  1 40 relative budget and cash position of the state
  1 41 resources.
  1 42    5.  Moneys received under this section shall not be
  1 43 commingled with state aid payments made under section
  1 44 257.16 to a school district and shall be accounted for
  1 45 by the school district separately from state aid
  1 46 payments.
  1 47    6.  Payments made to school districts under this
  1 48 section are miscellaneous income for purposes of
  1 49 chapter 257 and are considered encumbered.  Each
  1 50 school district shall maintain a separate listing
  2  1 within their budgets for payments received and
  2  2 expenditures made pursuant to this section.
  2  3    7.  Moneys received under this section shall not be
  2  4 used for payment of any collective bargaining
  2  5 agreement or arbitrator's decision negotiated or
  2  6 awarded under chapter 20.
  2  7    8.  For purposes of this chapter, "school district"
  2  8 means a public school district, the Iowa braille and
  2  9 sight saving school, the state school for the deaf,
  2 10 and the Price laboratory school at the university of
  2 11 northern Iowa.
  2 12    9.  Moneys received under this section shall
  2 13 supplement, not supplant, moneys in school district
  2 14 budgets for talented and gifted programs for students
  2 15 enrolled in kindergarten through grade three.
  2 16    10.  Each school district shall submit an
  2 17 assessment of their kindergarten through grade three
  2 18 talented and gifted program results by July 1 of the
  2 19 fiscal year succeeding the year in which the school
  2 20 district received moneys under this section.  The
  2 21 department shall annually report the statewide results
  2 22 of the program to the chairpersons and the ranking
  2 23 members of the house and senate standing education
  2 24 committees by January 1.
  2 25    11.  School districts shall expend funds received
  2 26 pursuant to this section to support talented and
  2 27 gifted programs for children enrolled in kindergarten
  2 28 through grade three, including, but not limited to,
  2 29 training for regular classroom teachers in improved
  2 30 instructional strategies that better support talented
  2 31 and gifted students."
