1 1 Amend Senate File 2366 as follows:
1 2 #1. By striking page 4, line 31, through page 6,
1 3 line 15 and inserting the following:
1 4 "Sec. ___. NEW SECTION. 256.44 TALENTED AND
1 5 GIFTED GRANT PROGRAM APPROPRIATION DISTRIBUTION.
1 6 1. There is appropriated from the general fund of
1 7 the state to the department of education for the
1 8 fiscal year beginning July 1, 1998, and for each
1 9 succeeding fiscal year, the sum of five hundred fifty
1 10 thousand dollars for the talented and gifted grant
1 11 program.
1 12 2. The department shall establish a talented and
1 13 gifted grant program to provide for the awarding of
1 14 grant moneys, appropriated pursuant to subsection 1,
1 15 to public school districts for purposes of increasing
1 16 the numbers or reach of programs for children who are
1 17 talented and gifted as defined in section 257.44.
1 18 3. For each fiscal year for which moneys are
1 19 appropriated in subsection 1, the amount of moneys
1 20 allocated to individual school districts shall be in
1 21 the proportion that the basic enrollment of the
1 22 district bears to the sum of the basic enrollments of
1 23 all school districts in the state for the budget year.
1 24 The Iowa braille and sight saving school, the state
1 25 school for the deaf, and the Price laboratory school
1 26 at the university of northern Iowa shall annually
1 27 certify their basic enrollments to the department of
1 28 education by October 1.
1 29 4. For each year for which an appropriation is
1 30 made to the talented and gifted grant program, the
1 31 department of education shall notify the department of
1 32 revenue and finance of the amount to be paid to each
1 33 school district based upon the distribution formula
1 34 set forth for the appropriation made pursuant to this
1 35 section. The allocation to each school district under
1 36 this section shall be made in one payment on or about
1 37 October 15 of the fiscal year for which the
1 38 appropriation is made, taking into consideration the
1 39 relative budget and cash position of the state
1 40 resources.
1 41 5. Moneys received under this section shall not be
1 42 commingled with state aid payments made under section
1 43 257.16 to a school district and shall be accounted for
1 44 by the school district separately from state aid
1 45 payments.
1 46 6. Payments made to school districts under this
1 47 section are miscellaneous income for purposes of
1 48 chapter 257 and are considered encumbered. Each
1 49 school district shall maintain a separate listing
1 50 within their budgets for payments received and
2 1 expenditures made pursuant to this section.
2 2 7. Moneys received under this section shall not be
2 3 used for payment of any collective bargaining
2 4 agreement or arbitrator's decision negotiated or
2 5 awarded under chapter 20.
2 6 8. For purposes of this chapter, "school district"
2 7 means a public school district, the Iowa braille and
2 8 sight saving school, the state school for the deaf,
2 9 and the Price laboratory school at the university of
2 10 northern Iowa.
2 11 9. The department shall make recommendations for,
2 12 and the state board shall adopt, rules relating to
2 13 talented and gifted grant program goals and program
2 14 administration."

2 17 #3. By renumbering, relettering, and redesignating
2 18 as necessary.
