  1  1    Amend Senate File 2280 as follows:
  1  2    #1.  Page 16, by inserting after line 3 the
  1  3 following:
  1  4    "4A.  SOUTHEAST ASIAN AFFAIRS DIVISION
  1  5    For salaries, support, maintenance, miscellaneous
  1  6 purposes, and for not more than the following full-
  1  7 time equivalent positions:

  1 10    The funds appropriated in this subsection shall be
  1 11 used by the department to establish, beginning January
  1 12 1, 1999, a division of southeast Asian affairs
  1 13 pursuant to sections 216A.150 through 216A.157, if
  1 14 enacted.
  1 15    #2.  Page 20, by inserting after line 7 the
  1 16 following:
  1 17    "Sec. 100.  NEW SECTION.  216A.150  DEFINITIONS.
  1 18    For purposes of this subchapter, unless the context
  1 19 otherwise requires:
  1 20    1.  "Administrator" means the administrator of the
  1 21 division of southeast Asian affairs of the department
  1 22 of human rights.
  1 23    2.  "Commission" means the commission of southeast
  1 24 Asian affairs.
  1 25    3.  "Division" means the division of southeast
  1 26 Asian affairs of the department of human rights.
  1 27    Sec. 101.  NEW SECTION.  216A.151  COMMISSION OF
  1 28 SOUTHEAST ASIAN AFFAIRS – TERMS – COMPENSATION.
  1 29    The commission of southeast Asian affairs consists
  1 30 of nine members, appointed by the governor.
  1 31 Commission members shall be appointed in compliance
  1 32 with sections 69.16 and 69.16A and with consideration
  1 33 given to geographic residence and density of southeast
  1 34 Asian population represented by each member.  The
  1 35 members of the commission shall be appointed during
  1 36 the month of June and shall serve for terms of two
  1 37 years commencing July 1 of each odd-numbered year.
  1 38 Members appointed shall continue to serve until their
  1 39 respective successors are appointed.  Vacancies in the
  1 40 membership of the commission shall be filled by the
  1 41 original appointing authority and in the manner of the
  1 42 original appointments.  Members shall receive actual
  1 43 expenses incurred while serving in their official
  1 44 capacity.  Members may also be eligible to receive
  1 45 compensation as provided in section 7E.6.
  1 46    Sec. 102.  NEW SECTION.  216A.152  ORGANIZATION.
  1 47    The commission shall select from its membership a
  1 48 chairperson and other officers as it deems necessary
  1 49 and shall meet not less than six times a year.  A
  1 50 majority of the members of the commission shall
  2  1 constitute a quorum.
  2  2    Sec. 103.  NEW SECTION.  216A.153  COMMISSION
  2  3 EMPLOYEES.
  2  4    The commission may employ personnel who shall be
  2  5 qualified to assume the responsibilities of their
  2  6 several offices.  The administrator shall be the
  2  7 administrative officer of the commission and shall
  2  8 serve the commission by gathering and disseminating
  2  9 information, forwarding proposals and evaluations to
  2 10 the governor, the general assembly, and state
  2 11 agencies, carrying out public education programs,
  2 12 conducting hearings and conferences, and performing
  2 13 other duties necessary for the proper operation of the
  2 14 commission.  The administrator shall carry out
  2 15 programs and policies as determined by the commission.
  2 16    Sec. 104.  NEW SECTION.  216A.154  DUTIES.
  2 17    The commission shall:
  2 18    1.  Coordinate, assist, and cooperate with the
  2 19 efforts of state departments and agencies to serve the
  2 20 needs of southeastern Asian persons in the fields of
  2 21 education, employment, health, housing, welfare, and
  2 22 recreation.
  2 23    2.  Develop, coordinate, and assist other public
  2 24 organizations which serve southeastern Asian persons.
  2 25    3.  Evaluate existing programs and proposed
  2 26 legislation affecting southeastern Asian persons, and
  2 27 propose new programs.
  2 28    4.  Stimulate public awareness of the problems of
  2 29 southeastern Asian persons by conducting a program of
  2 30 public education and encouraging the governor and the
  2 31 general assembly to develop programs to deal with
  2 32 these problems.
  2 33    5.  Conduct training programs for southeastern
  2 34 Asian persons to enable them to assume leadership
  2 35 positions on the community level.
  2 36    6.  Conduct a survey of the southeastern Asian
  2 37 people in Iowa in order to ascertain their needs.
  2 38    7.  Work to establish a southeastern Asian
  2 39 information center in the state of Iowa.
  2 40    8.  Pursuant to section 216A.2, be responsible for
  2 41 budgetary and personnel decisions for the commission
  2 42 and division.
  2 43    9.  Maintain information on the qualifications of
  2 44 southeastern Asian language interpreters and maintain
  2 45 and provide a list of those deemed qualified to Iowa
  2 46 courts or administrative agencies, as requested.
  2 47    Sec. 105.  NEW SECTION.  216A.155  POWERS.
  2 48    The commission shall have all powers necessary to
  2 49 carry out the functions and duties specified in this
  2 50 subchapter, including, but not limited to, the power
  3  1 to establish advisory committees on special studies,
  3  2 to solicit and accept gifts and grants, adopt rules
  3  3 according to chapter 17A for the commission and
  3  4 division, and to contract with public and private
  3  5 groups to conduct its business.  All departments,
  3  6 divisions, agencies, and offices of the state shall
  3  7 make available upon request of the commission
  3  8 information which is pertinent to the subject matter
  3  9 of the study and which is not by law confidential.
  3 10    Sec. 106.  NEW SECTION.  216A.156  REPORT.
  3 11    The commission shall make a detailed report of its
  3 12 activities, studies, findings, conclusions, and
  3 13 recommendations to the general assembly not later than
  3 14 February 15 of each odd-numbered year."
  3 15    #3.  Page 22, by inserting after line 30 the
  3 16 following:
  3 17    "3.  Sections 100 through 106 of this Act, enacting
  3 18 sections 216A.150 through 216A.156, take effect
  3 19 January 1, 1999."
