There is appropriated from the rebuild 4 50 Iowa infrastructure fund to the department of general 5 1 services for the fiscal year beginning July 1, 1999, 5 2 and ending June 30, 2000, the following amount, or so 5 3 much thereof as is necessary, to be used for the 5 4 purpose designated: 5 5 For construction of a new gymnasium building at the 5 6 state training school: 5 7 .................................................. $ 4,000,000 5 8 Sec. 6. The department of general services, after 5 9 consulting with the appropriate committee designated 5 10 by the legislative council, shall contract with a 5 11 private person with experience in evaluating the 5 12 renovation and repair needs of vertical infrastructure 5 13 as defined in section 8.57, subsection 5, paragraph 5 14 "c", to conduct the survey of the condition of state- 5 15 owned property. 5 16 DEPARTMENT OF ECONOMIC DEVELOPMENT 5 17 Sec. 7. There is appropriated from the rebuild 5 18 Iowa infrastructure fund to the department of economic 5 19 development for the fiscal year beginning July 1, 5 20 1997, and ending June 30, 1998, the following amounts, 5 21 or so much thereof as is necessary, to be used for the 5 22 purposes designated: 5 23 1. For a welcome center at living history farms: 5 24 ................................................... $ 500,000 5 25 2. For the main street investments loan program: 5 26 .................................................. $ 200,000 5 27 Notwithstanding section 8.33, the unencumbered or 5 28 unobligated moneys remaining on June 30 of the fiscal 5 29 year from the moneys appropriated in this section may 5 30 be expended during the following fiscal year for the 5 31 same purpose. 5 32 Sec. 8. 1996 Iowa Acts, chapter 1218, section 55, 5 33 unnumbered paragraph 1, is amended to read as follows: 5 34 There is appropriated from the rebuild Iowa 5 35 infrastructure fund of the state, notwithstanding 5 36 section 8.57, subsection 5, paragraph "c", to the Iowa 5 37 department of economic development for the fiscal 5 38 years beginning July 1, 1996, and ending June 30, 5 39 1998, the following amounts, or so much thereof as is 5 40 necessary, to be deposited in the physical 5 41 infrastructure assistance fund created in section 5 42 15E.175 and used only in accordance with subsection 3, 5 43 provided that the department, to the best of its 5 44 abilities, expend the funds on projects which meet the 5 45 definition of vertical infrastructure: 5 46 Sec. 9. 1996 Iowa Acts, chapter 1218, section 55, 5 47 subsection 2, is amended to read as follows: 5 48 2. There is appropriated from the marine 6 19 fuel tax receipts deposited in the general fund of the 6 20 state to the department of natural resources for the 6 21 fiscal year beginning July 1, 1997, and ending June 6 22 30, 1998, the following amount, or so much thereof as 6 23 is necessary, to be used for the purpose designated: 6 24 For the purpose of funding capital projects funded 6 25 from marine fuel tax receipts for the purposes 6 26 specified in section 452A.79: 6 27 .................................................. $ 1,800,000 6 28 Notwithstanding section 8.33, unencumbered or 6 29 unobligated funds remaining on June 30, 1998, from the 6 30 funds appropriated in this section, shall revert to 6 31 the general fund of the state on August 31, 1998. 6 32 STATE DEPARTMENT OF TRANSPORTATION 6 33 Sec. 12. There is appropriated from the rebuild 6 34 Iowa infrastructure fund to the state department of 6 35 transportation for the fiscal year beginning July 1, 6 36 1997, and ending June 30, 1998, the following amount, 6 37 or so much thereof as is necessary, to be used for the 6 38 purpose designated: 6 39 For allocating $75,000 for the Nishna Valley trail 6 40 project at Anita state park, for allocating $1,000,000 6 41 to be used for funding Iowa's portion of the American 6 42 discovery trail, and for acquiring, constructing, and 6 43 improving recreational trails within the state: 6 44 ................................................... $ 2,000,000 6 45 DEPARTMENT OF REVENUE AND FINANCE 6 46 Sec. 13. Notwithstanding section 8.57, subsection 6 47 5, paragraph "c", there is appropriated from the 6 48 rebuild Iowa infrastructure fund to the department of 6 49 revenue and finance for the fiscal year beginning July 6 50 1, 1997, and ending June 30, 1998, the following 7 1 amount, or so much thereof as is necessary, to be used 7 2 for the purpose designated: 7 3 For upgrades to the Iowa financial accounting 7 4 system, provided that none of the moneys appropriated 7 5 in this section shall be used for personnel expenses 7 6 not associated with the installation of the upgrades 7 7 to the system or for training expenses: 7 8 .................................................. $ 1,875,000 7 9 DEPARTMENT OF PUBLIC SAFETY 7 10 Sec. 14. Notwithstanding section 8.57, subsection 7 11 5, paragraph "c", there is appropriated from the 7 12 rebuild Iowa infrastructure fund to the department of 7 13 public safety for the fiscal period beginning July 1, 7 14 1997, and ending June 30, 2000, the following amount, 7 15 or so much thereof as is necessary, to be used for the 7 16 conversion of the department of public safety's radio 7 17 system from analog to digital technology, provided 7 18 that none of the moneys appropriated in this section 7 19 shall be used for personnel expenses not associated 7 20 with the installation of the radio system or for 7 21 training expenses: 7 22 1. For the fiscal year beginning July 1, 1999, and 7 29 ending June 30, 2000: 7 30 .................................................. $ 2,339,200 7 31 The department of public safety shall notify local 7 32 law enforcement agencies and fire departments of the 7 33 department's intent to purchase new radio equipment 7 34 and shall allow any local law enforcement agency or 7 35 fire department, which wishes to purchase with its own 7 36 funds on the same purchase order, to participate in 7 37 the joint purchase in order to purchase new radio 7 38 equipment for the local law enforcement agency or fire 7 39 department. 7 40 Notwithstanding section 8.33, unencumbered or 7 41 unobligated moneys remaining on June 30, 2001, shall 7 42 revert on August 31, 2001. 7 43 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 7 44 Sec. 15. There is appropriated from the rebuild 7 45 Iowa infrastructure fund, notwithstanding section 7 46 8.57, subsection 5, paragraph "c", to the department 7 47 of agriculture and land stewardship for the fiscal 7 48 period beginning July 1, 1997, and ending June 30, 7 49 1999, the following amounts, or so much thereof as is 7 50 necessary, to be used for deposit in the alternative 8 1 drainage system assistance fund created in section 8 2 159.29A, if enacted by 1997 Iowa Acts, Senate File 8 3 473, for purposes of supporting the alternative 8 4 drainage system assistance program administered by the 8 5 soil conservation division of the department of 8 6 agriculture and land stewardship as provided in 8 7 section 159.29B, if enacted by 1997 Iowa Acts, Senate 8 8 File 473: 8 9 1. For the fiscal year beginning July 1, 1997, and 8 10 ending June 30, 1998: 8 11 .................................................. $ 1,000,000 8 12 2. Notwithstanding section 8.57, subsection 8 35 5, paragraph "c", there is appropriated from the 8 36 rebuild Iowa infrastructure fund to the department of 8 37 human services for the fiscal period beginning July 1, 8 38 1997, and ending June 30, 1999, the following amounts, 8 39 or so much thereof as is necessary, to be used for 8 40 implementing child support systems changes 8 41 necessitated by changes in federal welfare reform 8 42 legislation, provided that none of the moneys 8 43 appropriated in this section shall be used for 8 44 personnel expenses associated with the implementation 8 45 of the systems changes or for training expenses: 8 46 1. There is appropriated from the rebuild 9 22 Iowa infrastructure fund, notwithstanding section 9 23 8.57, subsection 5, paragraph "c", to the Loess Hills 9 24 development and conservation authority for the fiscal 9 25 year beginning July 1, 1997, and ending June 30, 1998, 9 26 the following amount, or so much thereof as is 9 27 necessary, to be used for the purpose designated: 9 28 For deposit in the Loess Hills development and 9 29 conservation fund created in section 161D.2 for the 9 30 purposes specified in section 161D.1: 9 31 .................................................. $ 742,500 9 32 IOWA STATE FAIR FOUNDATION 9 33 Sec. 20. There is appropriated from the rebuild 9 34 Iowa infrastructure fund of the state to the Iowa 9 35 state fair foundation for the fiscal year beginning 9 36 July 1, 1997, and ending June 30, 1998, the following 9 37 amount, or so much thereof as is necessary, to be used 9 38 for the purpose designated: 9 39 For renovation, restoration, and improvement 9 40 projects on the state fairgrounds and for distributing 9 41 in accordance with chapter 174, $1,060,000 to 9 42 qualified fairs which belong to the association of 9 43 Iowa fairs: 9 44 .................................................. $ 5,460,000 9 45 Notwithstanding section 8.33, the unencumbered or 9 46 unobligated moneys remaining on June 30 of the fiscal 9 47 year from the moneys appropriated in this section may 9 48 be expended during the following fiscal year for the 9 49 same purpose. 9 50 Sec. 21. Effective July 1, 1997, the departments 10 1 of general services, workforce development, human 10 2 services, and public safety, and the commission on 10 3 veterans affairs are authorized to enter into 10 4 contracts for the full cost of carrying out the 10 5 projects for which appropriations are made in this 10 6 division of this Act. The state shall not be 10 7 obligated for costs associated with contracts 10 8 identified in this section in excess of funds 10 9 appropriated by the general assembly. 10 10 DIVISION II 10 11 STATE BOARD OF REGENTS 10 12 Sec. 22. 10 13 1. There is appropriated from the rebuild Iowa 10 14 infrastructure fund of the state to the state board of 10 15 regents for the fiscal period beginning July 1, 1997, 10 16 and ending June 30, 2001, the following amounts, or so 10 17 much thereof as is necessary, to be used for the 10 18 projects designated in subsection 2: 10 19 a. For the fiscal year beginning July 1, 1997, and 10 20 ending June 30, 1998: 10 21 .................................................. $ 19,500,000 10 22 b. For the fiscal year beginning July 1, 1998, and 10 23 ending June 30, 1999: 10 24 .................................................. $ 19,500,000 10 25 c. However, the total appropriated funds for a 10 36 project for all fiscal years of that fiscal period 10 37 shall not exceed the amount listed in subsection 2 for 10 38 that project. 10 39 2. The state board of regents is authorized to 10 40 undertake, plan, construct, equip, and otherwise carry 10 41 out the following projects at the institutions under 10 42 the jurisdiction of the board in the following 10 43 appropriated amounts: 10 44 a. For construction of the livestock infectious 10 45 disease isolation facility at Iowa state university of 10 46 science and technology: 10 47 .................................................. $ 9,270,000 10 48 b. Conditioned upon the state board of regents 11 13 allocating funding for building maintenance at the 11 14 Iowa school for the deaf for the fiscal year beginning 11 15 July 1, 1997, and ending June 30, 1998, in an amount 11 16 equal to or greater than the amount of funding 11 17 allocated for that purpose in the previous fiscal 11 18 year, the following amount, to be used for a visual 11 19 alert system and to address fire safety deficiencies 11 20 at the Iowa school for the deaf: 11 21 .................................................. $ 110,000 11 22 g. Conditioned upon the state board of regents 11 23 allocating funding for building maintenance at the 11 24 Iowa braille and sight saving school for the fiscal 11 25 year beginning July 1, 1997, and ending June 30, 1998, 11 26 in an amount equal to or greater than the amount of 11 27 funding allocated for that purpose in the previous 11 28 fiscal year, the following amount, to be used for 11 29 deferred maintenance at the Iowa braille and sight 11 30 saving school: 11 31 .................................................. $ 95,000 11 32 3. Effective July 1, 1997, the state board of 11 33 regents is authorized to enter into contracts for the 11 34 full cost of carrying out the projects listed in 11 35 subsection 2, for which appropriations are made in 11 36 subsection 1, for the fiscal years beginning July 1, 11 37 1997, July 1, 1998, July 1, 1999, and July 1, 2000. 11 38 The state shall not be obligated for costs 11 39 associated with contracts identified in this section 11 40 in excess of funds appropriated by the general 11 41 assembly. 11 42 4. a. Notwithstanding section 8.33, funds 11 43 appropriated in subsection 1, paragraph "a", for the 11 44 fiscal year beginning July 1, 1997, which remain 11 45 unexpended as of June 30, 1998, shall be available for 11 46 expenditure through June 30, 2002. 11 47 b. Notwithstanding section 8.33, funds 11 48 appropriated in subsection 1, paragraph "b", for the 11 49 fiscal year beginning July 1, 1998, which remain 11 50 unexpended as of June 30, 1999, shall be available for 12 1 expenditure through June 30, 2003. 12 2 c. Notwithstanding section 8.33, funds 12 3 appropriated in subsection 1, paragraph "c", for the 12 4 fiscal year beginning July 1, 1999, which remain 12 5 unexpended as of June 30, 2000, shall be available for 12 6 expenditure through June 30, 2004. 12 7 d. Notwithstanding section 8.33, funds 12 8 appropriated in subsection 1, paragraph "d", for the 12 9 fiscal year beginning July 1, 2000, which remain 12 10 unexpended as of June 30, 2001, shall be available for 12 11 expenditure through June 30, 2005. 12 12 The board of regents shall not submit a request to 12 13 the governor or general assembly for funding from the 12 14 rebuild Iowa infrastructure fund or other funds for 12 15 capital projects, including funding for planning for 12 16 capital projects, until fiscal year 2001, except for 12 17 project or planning funding requested for the Iowa 12 18 school for the deaf or the Iowa braille and sight 12 19 saving school. 12 20 DIVISION III 12 21 COMMUNITY COLLEGE VOCATIONAL-TECHNICAL 12 22 TECHNOLOGY IMPROVEMENT PROGRAM 12 23 Sec. 23. NEW SECTION. 260A.1 COMMUNITY COLLEGE 12 24 VOCATIONAL-TECHNICAL TECHNOLOGY IMPROVEMENT 12 25 APPROPRIATION. 12 26 1. Notwithstanding section 8.57, subsection 5, 12 27 paragraph "c", there is appropriated from the rebuild 12 28 Iowa infrastructure fund created in section 8.57, to 12 29 the department of education for each fiscal year of 12 30 the fiscal period beginning July 1, 1997, and ending 12 31 June 30, 2001, the sum of two million five hundred 12 32 thousand dollars for the community college vocational- 12 33 technical technology improvement program. 12 34 2. Moneys appropriated in subsection 1 shall be 12 35 allocated by the department of education to each 12 36 community college in the proportion that the 12 37 allocation to that community college in 1996 Iowa 12 38 Acts, chapter 1215, section 6, subsection 15, bears to 12 39 the total appropriation made in 1996 Iowa Acts, 12 40 chapter 1215, section 6, subsection 15, to all 12 41 community colleges. 12 42 3. For each year in which an appropriation is made 12 43 to the community college vocational-technical 12 44 technology improvement program, the department of 12 45 education shall notify the department of revenue and 12 46 finance of the amount to be paid to each community 12 47 college based upon the allocation criteria set forth 12 48 for the appropriation pursuant to subsection 2. 12 49 Allocations to each community college under this 12 50 section shall be made in one payment on or about 13 1 October 15 and one payment on or about February 15 of 13 2 the fiscal year in which the appropriation is made, 13 3 taking into consideration the relative budget and cash 13 4 position of the state resources. 13 5 4. Moneys received by a community college under 13 6 this section shall not be commingled with general 13 7 state financial aid, including financial aid to merged 13 8 areas in lieu of personal property tax replacement 13 9 payments under section 427A.13, to merged areas as 13 10 defined in section 260C.2, and including moneys 13 11 received for vocational education programs in 13 12 accordance with chapters 258 and 260C. Payments made 13 13 to a community college shall be accounted for by the 13 14 community college separately from other state aid 13 15 payments. Each community college shall maintain a 13 16 separate listing within its budget accounting for 13 17 payments received and expenditures made pursuant to 13 18 this section and section 260A.3. 13 19 5. Moneys received under this section shall 13 20 supplement, not supplant, the moneys each community 13 21 college budgets for technology. A community college 13 22 shall not be eligible for funds under this section 13 23 unless the community college, without including moneys 13 24 received under this section, maintains the same 13 25 average amount of expenditure for technology per year 13 26 as the community college maintains during the fiscal 13 27 period beginning July 1, 1994, and ending June 30, 13 28 1997. 13 29 6. Moneys received under this section shall not be 13 30 used for payment of any collective bargaining 13 31 agreement or arbitrator's decision negotiated or 13 32 awarded under chapter 20. 13 33 Sec. 24. NEW SECTION. 260A.2 COMMUNITY COLLEGE 13 34 VOCATIONAL-TECHNICAL TECHNOLOGY IMPROVEMENT PLANS. 13 35 Prior to receiving moneys under this chapter, the 13 36 board of directors of a community college shall adopt 13 37 a technology plan that supports community college 13 38 vocational-technical technology improvement efforts, 13 39 authorizes a needs assessment of business and industry 13 40 in the district, and includes an evaluation component, 13 41 and shall provide to the department of education 13 42 adequate assurance that funds received under this 13 43 chapter will be used in accordance with the technology 13 44 plan. The plan shall be developed by licensed 13 45 professional staff of the community college, including 13 46 both faculty members and school administrators, the 13 47 private sector, trade and professional organizations, 13 48 and other interested parties, and shall, at a minimum, 13 49 focus on the attainment of the vocational-technical 13 50 skills and achievement goals of the student. The plan 14 1 shall consider the community college's 14 2 interconnectivity with the Iowa communications 14 3 network, and shall demonstrate how, over a four-year 14 4 period, the board will utilize technology to improve 14 5 vocational-technical student achievement. The 14 6 technology plan shall be kept on file at the community 14 7 college. Progress made under the plan shall be 14 8 reported annually to the department of education in a 14 9 manner prescribed by the department of education. 14 10 Sec. 25. NEW SECTION. 260A.3 COMMUNITY COLLEGE 14 11 VOCATIONAL-TECHNICAL TECHNOLOGY IMPROVEMENT 14 12 EXPENDITURES. 14 13 A community college shall expend funds received 14 14 pursuant to section 260A.1 for the acquisition, lease, 14 15 lease-purchase, installation, and maintenance of 14 16 instructional technology equipment used in vocational- 14 17 technical programs, including hardware and software, 14 18 materials and supplies related to instructional 14 19 technology, and faculty development and training 14 20 related to instructional technology, and shall 14 21 establish priorities for the use of the funds. 14 22 However, funds received by a community college 14 23 pursuant to section 260A.1 shall not be expended to 14 24 add a full-time equivalent position or otherwise 14 25 increase staffing. 14 26 Sec. 26. NEW SECTION. 260A.4 FUTURE REPEAL. 14 27 This chapter is repealed effective July 1, 2001. 14 28 DIVISION IV 14 29 MISCELLANEOUS STATUTORY CHANGES 14 30 Sec. 27. NEW SECTION. 7E.5A BUILDINGS AND 14 31 INFRASTRUCTURE MAINTENANCE FUNDING. 14 32 1. For each new vertical infrastructure project 14 33 undertaken on or after July 1, 1997, the department in 14 34 control of the vertical infrastructure shall identify 14 35 and recommend to the general assembly funding 14 36 sufficient to meet the projected maintenance, repair, 14 37 and replacement needs of the vertical infrastructure. 14 38 2. As used in this section, "vertical 14 39 infrastructure" means the same as defined in section 14 40 8.57, subsection 5, paragraph "c". 14 41 Sec. 28. NEW SECTION. 15E.176 MAIN STREET 14 42 INVESTMENTS LOAN PROGRAM. 14 43 The department shall adopt rules to implement a 14 44 main street investments loan program to increase the 14 45 availability of lower cost funds to stimulate building 14 46 restorations or rehabilitations of historic buildings 14 47 within the central business district of a city which 14 48 is a certified local government, or in the Iowa main 14 49 street program or the rural main street program. The 14 50 rules shall include the following conditions: 15 1 1. Investment loans shall be limited to projects 15 2 for a building restoration or rehabilitation located 15 3 in the central business district whose boundaries are 15 4 the same as the main street or rural main street or 15 5 central business district of a city which is a 15 6 certified local government project area. 15 7 2. Eligible borrowers are limited to the property 15 8 owner, contract purchaser of record, or long-term 15 9 lessee. 15 10 3. Loan applications under this program shall be 15 11 for the restoration or rehabilitation of buildings 15 12 which are eligible or nominated or listed on the 15 13 national register of historic places. Public 15 14 buildings are excluded. 15 15 4. The maximum loan amount under the main street 15 16 investments loan program is fifty thousand dollars per 15 17 project. 15 18 Sec. 29. NEW SECTION. 15.177 APPLICATION 15 19 PROCESS. 15 20 Applicants shall be certified as eligible for 15 21 assistance prior to submitting applications to the 15 22 department for loans under the main street investment 15 23 loan program. Administrative rules pursuant to 15 24 chapter 17A shall be adopted by the department in 15 25 consultation with the department of cultural affairs 15 26 to require applicants to do the following: 15 27 1. Show evidence of preliminary design assistance. 15 28 2. Show evidence of preliminary design review 15 29 approval from the local design review committee. 15 30 3. Submit project plans and specifications 15 31 prepared by a design professional with historic 15 32 preservation experience. 15 33 Sec. 30. NEW SECTION. 18.24 COORDINATION OF 15 34 VERTICAL INFRASTRUCTURE DATABASES. 15 35 1. The director shall establish by administrative 15 36 rule, and as part of a survey conducted regarding the 15 37 condition of state-owned property, a uniform system 15 38 for evaluating and rating vertical infrastructure 15 39 needs in the state so that the vertical infrastructure 15 40 needs of each state entity and proposed vertical 15 41 infrastructure projects, including the state board of 15 42 regents, can be compared. The director shall consult 15 43 with state entities which already have databases 15 44 regarding their vertical infrastructure needs and 15 45 shall seek input from individuals or organizations 15 46 with expertise in public vertical infrastructure 15 47 assessment in drafting proposed rules. 15 48 2. As used in this section, "vertical 15 49 infrastructure" has the same meaning as in section 15 50 8.57, subsection 5, paragraph "c". 16 1 Sec. 31. Section 174.1, subsection 1, Code 1997, 16 2 is amended to read as follows: 16 3 1. "Fair" shall meana bona fide exhibition of16 4agricultural, dairy, and kindred products, livestock,16 5and farm implementsan annual gathering of people that 16 6 incorporates agricultural exhibits, shows, or 16 7 competition which has the following activities: 16 8 a. Extension, 4-H, or future farmers of America 16 9 programs. 16 10 b. Commercial and educational exhibits. 16 11 c. Competition in the fine or home craft arts. 16 12 Sec. 32. Section 174.9, unnumbered paragraph 1, 16 13 Code 1997, is amended to read as follows: 16 14 Each eligible society which is a member of the 16 15 association of Iowa fairs and which conducts a county 16 16 fair shall be entitled to receive aid from the state 16 17 as provided in this chapter. In order to be eligible 16 18 for state aid, a society must file with thetreasurer16 19of stateIowa state fair foundation, as established in 16 20 section 173.22, on or before November 1 of each year, 16 21 a statement which shall show: 16 22 Sec. 33. Section 174.9, subsection 4, Code 1997, 16 23 is amended to read as follows: 16 24 4. A copy of the published financial statement 16 25 published as required by law, together with proof of 16 26 such publication and a certified statement showing an 16 27 itemized list of premiums awarded, and such other 16 28 information as thetreasurer of stateIowa state fair 16 29 foundation may require. 16 30 Sec. 34. Section 174.10, Code 1997, is amended to 16 31 read as follows: 16 32 174.10 APPROPRIATION AVAILABILITY. 16 33 1.Each county shall receive an equal share of any16 34moneys appropriated to support one or more societies16 35conducting one or more county fairs in that county, if16 36the society or societies are eligible for the state16 37aid. MoneysAny moneys appropriated for county or 16 38 local fairs shall be paid directly to each eligible 16 39 society which conducts a fair which qualifies for 16 40 funding. 16 41 2. The association of Iowa fairs shall provide the 16 42treasurer of stateIowa state fair foundation with a 16 43 list of each society in a county which is a member of 16 44 the association and conducts a fair in that county as 16 45 provided in this chapter. If a county has more than 16 46 one fair, the association shall list the name of each 16 47 society conducting a fair in that county for three or 16 48 more years. Thetreasurer of stateIowa state fair 16 49 foundation shall not authorize payment of state aid to 16 50 a society, unless the society complies with section 17 1 174.9 and the name of the society appears on the 17 2 association's list. 17 3 3.If a county has more than one fair eligible for17 4state aid, theThe amount of state aid forthat county17 5 each fair which is eligible for state aid shall be 17 6divided equally among the eligible societies in that17 7countyequal. 17 8 4. If no society in a county qualifies to receive 17 9 state aid, that county's share shall be divided 17 10 equally among the counties with societies eligible for 17 11 state aid, as provided in this section. 17 12 5.If an official county fair is designated by17 13election, the total amount of state aid for that17 14county shall be paid to that society determined to be17 15conducting the official county fair.The board of 17 16 supervisors, upon receiving a petition seeking to 17 17 designate an official county fair which meets the 17 18 requirements of section 331.306, shall submit to the 17 19 registered voters of the county at the next general 17 20 election following submission of the petition or at a 17 21 special election if requested by the petitioners at no 17 22 cost to the county, the question of which fair shall 17 23 be designated as the official county fair. Notice of 17 24 the election shall be given as provided in section 17 25 49.53. The fair receiving a majority of the votes 17 26 cast on the question shall be designated the official 17 27 county fair. 17 28 Sec. 35. Section 174.12, unnumbered paragraph 1, 17 29 Code 1997, is amended to read as follows: 17 30 The department of revenue and finance shall issue a 17 31 warrant to a society for the amount due in state aid, 17 32 less five hundred dollars, as provided in this 17 33 chapter. Thetreasurer of stateIowa state fair 17 34 foundation must certify to the department that the 17 35 society is eligible under this chapter to receive the 17 36 amount due provided in section 174.10. The department 17 37 shall issue a warrant to the society for the remaining 17 38 five hundred dollars, if all of the following apply: 17 39 Sec. 36. Section 452A.79, unnumbered paragraph 2, 17 40 Code 1997, is amended to read as follows: 17 41 All moneys derived from the excise tax on the sale 17 42 of motor fuel used in watercraft shall be deposited in 17 43 the general fund of the state. Moneys deposited to 17 44 the general fund under this section and section 17 45 452A.84 are subject to the requirements of section 17 46 8.60 and are subject to appropriation by the general 17 47 assembly to the department of natural resources for 17 48 use in its recreational boating program, which may17 49include but is not limited toas follows: 17 50 Sec. 37. Section 452A.79, subsection 1, Code 1997, 18 1 is amended to read as follows: 18 2 1. Dredging and renovation of natural or state- 18 3 maintained lakes of this state. 18 4 Sec. 38. NEW SECTION. 461A.3A RESTORE THE 18 5 OUTDOORS PROGRAM. 18 6 1. The department shall establish a restore the 18 7 outdoors program. The purpose of the program is to 18 8 provide funding for projects involving existing 18 9 vertical infrastructure as defined in section 8.57, 18 10 subsection 5, paragraph "c", or the construction of 18 11 new vertical infrastructure if the new construction is 18 12 required due to increased demand for facilities at the 18 13 park or if it is not cost-effective to repair or 18 14 renovate the existing vertical infrastructure. 18 15 Projects shall be limited to existing state parks and 18 16 other public facilities managed by the department. 18 17 2. There is appropriated from the rebuild Iowa 18 18 infrastructure fund for each fiscal year of the fiscal 18 19 period beginning July 1, 1997, and ending June 30, 18 20 2001, the sum of three million dollars to the 18 21 department for use in the restore the outdoors 18 22 program. Notwithstanding section 8.33, unencumbered 18 23 or unobligated moneys remaining at the end of a fiscal 18 24 year shall not revert but shall remain available for 18 25 expenditure during the following fiscal year for 18 26 purposes of the restore the outdoors program. 18 27 The department shall provide in its annual budget 18 28 documentations to the governor and general assembly a 18 29 report on the use of moneys under the program since 18 30 the last report and the projected use of future 18 31 moneys." 18 32 #2.
