  1  1    Amend the Senate amendment, H-1692, to House File
  1  2 707, as amended, passed, and reprinted by the House,
  1  3 as follows:
  1  4    #1.  Page 2, by striking lines 2 through 14 and
  1  5 inserting the following:  "motor vehicle, except that
  1  6 a conviction or revocation under section 321J.2".
  1  7    #2.  By striking page 2, line 49 through page 3,
  1  8 line 5, and inserting the following:
  1  9    "(1)  Imprisonment in the county jail for not less
  1 10 than forty-eight hours, to be served as ordered by the
  1 11 court, less credit for any time the person was
  1 12 confined in a jail or detention facility following
  1 13 arrest, and assessed.  However,".
  1 14    #3.  Page 3, by inserting after line 10 the
  1 15 following:  "However, in the discretion of the court,
  1 16 if no personal or property injury has resulted from
  1 17 the defendant's actions, up to five hundred dollars of
  1 18 the fine may be waived."
  1 19    #4.  Page 3, by striking lines 38 through 40 and
  1 20 inserting the following:
  1 21    "#   .  Page 3, by inserting before line 4 the
  1 22 following:
  1 23    "(5)  If the offense under chapter 321J results in
  1 24 bodily injury to a person other than the defendant.""
  1 25    #5.  Page 4, lines 15 and 16, by striking the words
  1 26 "previous versions of".
  1 27    #6.  Page 4, by striking lines 23 through 25.
  1 28    #7.  Page 5, by striking lines 14 through 17.
  1 29    #8.  By striking page 6, line 50, through page 7,
  1 30 line 1, and inserting the following:  "321J.2, or the
  1 31 entry of a deferred judgment concerning a violation of
  1 32 section 321J.2, the court or juvenile".
  1 33    #9.  Page 8, by inserting before line 25 the
  1 34 following:
  1 35    "#   .  Page 29, by striking lines 15 through 18
  1 36 and inserting the following:  "321J.9, or 321J.12
  1 37 under chapter 321J, and any of the following apply:""
  1 38    #10.  Page 8, by striking lines 25 and 26 and
  1 39 inserting the following:
  1 40    "#   .  Page 29, by inserting before line 33 the
  1 41 following:
  1 42    "(5)  If the offense under chapter 321J results in
  1 43 bodily injury to a person other than the defendant.""
  1 44    #11.  Page 8, by inserting before line 27 the
  1 45 following:
  1 46    "#   .  Page 29, by inserting before line 33 the
  1 47 following:
  1 48    "Sec. ___.  Section 907.3, subsection 1, Code 1997,
  1 49 is amended by adding the following new paragraph:
  1 50    NEW PARAGRAPH.  j.  The offense is a violation of
  2  1 section 707.6A, subsection 1; or a violation of
  2  2 section 707.6A, subsection 3, involving operation of a
  2  3 motor vehicle while intoxicated.""
  2  4    #12.  Page 8, by striking lines 27 through 29, and
  2  5 inserting the following:
  2  6    "#   .  Page 30, by striking lines 21 through 23,
  2  7 and inserting the following:
  2  8    "c.  Section 321J.2, subsection 1, if"".
  2  9    #13.  Page 8, by inserting before line 30 the
  2 10 following:
  2 11    "#   .  Page 31, by inserting before line 4 the
  2 12 following:
  2 13    "(5)  If the offense under chapter 321J results in
  2 14 bodily injury to a person other than the defendant.
  2 15    d.  Section 707.6A, subsection 1; or section
  2 16 707.6A, subsection 3, involving operation of a motor
  2 17 vehicle while intoxicated.""
  2 18    #14.  Page 8, by striking lines 30 through 32 and
  2 19 inserting the following:
  2 20    "#   .  Page 31, by striking lines 31 through 33
  2 21 and inserting the following:  "321J.2, subsection 1,
  2 22 if any of the following"."
  2 23    #15.  Page 8, by inserting before line 33 the
  2 24 following:
  2 25    "#   .  Page 32, by inserting before line 14 the
  2 26 following:
  2 27    "(5)  If the offense under chapter 321J results in
  2 28 bodily injury to a person other than the defendant.
  2 29    d.  A sentence imposed pursuant to section 707.6A,
  2 30 subsection 1; or section 707.6A, subsection 3,
  2 31 involving operation of a motor vehicle while
  2 32 intoxicated.""
  2 33    #16.  By renumbering, relettering, or redesignating
  2 34 and correcting internal references as necessary.
