1 2 #1. Page 7, by inserting before line 22 the
1 3 following:
1 4 "Sec. . Section 99F.6, subsection 4, paragraph
1 5 a, Code 1997, is amended to read as follows:
1 6 a. Before a license is granted, the division of
1 7 criminal investigation of the department of public
1 8 safety shall conduct a thorough background
1 9 investigation of the applicant for a license to
1 10 operate a gambling game operation on an excursion
1 11 gambling boat. The applicant shall provide
1 12 information on a form as required by the division of
1 13 criminal investigation. A qualified sponsoring
1 14 organization licensed to operate gambling games under
1 15 this chapter shall distribute the receipts of all
1 16 gambling games, less reasonable expenses, charges,
1 17 taxes, fees, and deductions allowed under this
1 18 chapter, as winnings to players or participants or
1 19 shall distribute the receipts for educational, civic,
1 20 public, charitable, patriotic, or religious uses as
1 21 defined in section 99B.7, subsection 3, paragraph "b".
1 22 However, if a licensee who is also licensed to conduct
1 23 pari-mutuel wagering at a horse racetrack has unpaid
1 24 debt from the pari-mutuel racetrack operations, the
1 25 first receipts of the gambling games operated within
1 26 the racetrack enclosure less reasonable operating
1 27 expenses, taxes, and fees allowed under this chapter
1 28 shall be first used to pay the annual indebtedness.
1 29 The commission shall authorize, subject to the debt
1 30 payments for horse racetracks and the provisions of
1 31 paragraph "b" for dog racetracks, a licensee who is
1 32 also licensed to conduct pari-mutuel dog or horse
1 33 racing to use receipts from gambling games within the
1 34 racetrack enclosure to supplement purses for races
1 35 particularly for Iowa-bred horses pursuant to an
1 36 agreement which shall be negotiated between the
1 37 licensee and representatives of the dog or horse
1 38 owners. For a licensee who is also licensed to
1 39 conduct pari-mutuel horse racing, the supplement to
1 40 the horse race purses shall be an amount equal to
1 41 fifteen percent of the annual adjusted gross receipts
1 42 received from gambling games and, of the total sum
1 43 allocated to supplement horse race purses, twenty
1 44 percent shall be used to supplement the purses of
1 45 Iowa-bred horses. A qualified sponsoring organization
1 46 shall not make a contribution to a candidate,
1 47 political committee, candidate's committee, state
1 48 statutory political committee, county statutory
1 49 political committee, national political party, or
1 50 fund-raising event as these terms are defined in
2 1 section 56.2. The membership of the board of
2 2 directors of a qualified sponsoring organization shall
2 3 represent a broad interest of the communities."
