1 1 Amend Senate File 547 as follows:
1 2 #1. By striking page 10, line 28, through page 11,
1 3 line 27, and inserting the following:
1 4 "Sec. . Section 400.10, Code 1997, is amended
1 5 by striking the section and inserting in lieu thereof
1 6 the following:
1 7 400.10 PREFERENCES.
1 8 1. In all examinations and appointments under this
1 9 chapter, other than promotions and appointment of
1 10 chief of the police department or chief of the fire
1 11 department:
1 12 a. An applicant who is a veteran as defined in
1 13 section 35.1 shall have five points added to the
1 14 applicant's grade or score attained in the qualifying
1 15 examination for appointment to a position.
1 16 b. An applicant who is a veteran discharged under
1 17 honorable conditions from the military or naval forces
1 18 of the United States in any war in which the United
1 19 States has been engaged, including the Korean Conflict
1 20 at any time between June 25, 1950, and January 31,
1 21 1955, both dates inclusive, the Vietnam Conflict
1 22 beginning August 5, 1964, and ending May 7, 1975, both
1 23 dates inclusive, and the Persian Gulf Conflict
1 24 beginning August 2, 1990, and ending on the date
1 25 specified by the president or the Congress of the
1 26 United States as the date of permanent cessation of
1 27 hostilities, both dates inclusive, and who are
1 28 citizens and residents of this state, shall have ten
1 29 points added to the applicant's grade or score
1 30 attained in qualifying examinations for appointment to
1 31 a position. For the purposes of this paragraph, World
1 32 War II shall be from December 7, 1941, to December 31,
1 33 1946, both dates inclusive.
1 34 c. If an applicant qualifies as a veteran as
1 35 provided in paragraph "a" or "b" and has a service-
1 36 connected disability or is receiving compensation,
1 37 disability benefits, or pension under laws
1 38 administered by the veterans administration, five
1 39 additional points shall be added to the applicant's
1 40 grade or score awarded pursuant to paragraph "a" or
1 41 "b". An honorably discharged veteran who has been
1 42 awarded the Purple Heart for disabilities incurred in
1 43 action shall be considered to have a service-connected
1 44 disability.
1 45 2. However, the points awarded pursuant to
1 46 subsection 1 shall be added only upon passing the
1 47 examination and shall not be the determining factor in
1 48 passing the qualifying examination."
