1 2 #1. Page 2, by inserting after line 23 the
1 3 following:
1 4 "c. This subsection shall not apply to a
1 5 manufacturer, assembler, designer, supplier of
1 6 specifications, seller, lessor, or distributor of a
1 7 product, if the manufacturer, assembler, designer,
1 8 supplier of specifications, seller, lessor, or
1 9 distributor of a product knew that the product was
1 10 defective. For purposes of this subsection, a
1 11 manufacturer, assembler, designer, supplier of
1 12 specifications, seller, lessor, or distributor of a
1 13 product shall be deemed to have known of the defect if
1 14 either of the following apply:
1 15 (1) The manufacturer, assembler, designer,
1 16 supplier of specifications, seller, lessor, or
1 17 distributor of a product had been held liable in a
1 18 case in a court of competent jurisdiction where the
1 19 defective product was at issue.
1 20 (2) The manufacturer, assembler, designer,
1 21 supplier of specifications, seller, lessor, or
1 22 distributor of a product had tested the product and
1 23 the test indicated that the product was defective."
